Just a few brief details: Court date is in January to change custody from BM to me.  Custody evaluation was requested by GAL and approved by judge in August.  

I got the court order last week, only because I kept hounding my attorney.  It is possible that BM has not seen the order.  CO states that it is BM & BD responsibility to arrange appointments with the evaluator for themselves and child.  

I have met with evaluator once briefly, and have another appt scheduled.  BM has not done anything so far, so I am scrambling to arrange child's appointment ASAP.  

The only way to get child to the appt is to tell BM the date & time for her to take him, or I can not return him to her house at the scheduled time on one of our weekends.  Any thoughts or advice on that?

Myself and GAL were hoping to expose some of BM's major flaws with the evaluation.  

Would it be better or worse if BM just never goes to the eval?

If BM doesn't participate in eval, will that give them a reason to reschedule the court date again?

Court date is in January for change of custody from BM to me, & contempt against BM.

BM requested that we change our visitation three times in the last two months to better suit her schedule.  As always, I agreed each time.  We have been communicating via e-mail, and she has been very cordial...until now.

Last week I requested of her to make changes due to my schedule.  She was obviously put-off, and when I would not give her specific reasons for the change, she did not reply back, until today.  And of course she will not do it.  

She went on to say that she conferred with her attorney who thinks she should stick to the current court order.  And furthermore, any more requests I have should be directed through our attorneys.  And, get this!...she made sure to say that she would still be picking up son early this weekend as I had previously agreed to!  WTF?!

I'm so sick of this!  

I would like some input on what to do:

1) Respond with "OK, court order it is, no early pickup"
2) Respond with my disappointment / disgust of her lack of cooperation
3) Make no response, and allow the early pickup as agreed.
4) Make no response, and stick to the court ordered time of pickup.
5) Something else that my madness clouds my view of right now

Custody Issues / PAS in Alabama courts

I have found three cases in Alabama that relate directly to PAS and might be relevent to my case and others who post here. However, I am hitting some dead ends trying to obtain more details. Maybe someone out there a bit more computer savy than myself could be of assistance.

I will share what I already have:

C.J.L v. M.W.B., 2003 Ala. Civ. App., February 28, 2003
This case changed custody to the father, giving him sole physical custody. Mother appealed saying shouldn't have relied on doctor's diagnosis of PAS. The ruling was upheld by the appeals court.

CASE NO. DR-97-502272.03-C
Tina S Wilson
vs.
Drew C Wilson

This is a case filed in October 2003 in Mobile County. The judge is Rosemary D Chambers. A father's rights group has submitted a 40+ page brief to the judge supporting the BF's position in regards to the BM exhibiting signs of PAS. The brief is posted at //www.ancpr.org This case may very well be over by now, but I cannot seem to find any more info on the outcome.

This case envolves PAS somehow. That's all I know.

Custody Issues / erroneous restraining order

I will make this simple & to the point right now, but I'll be glad to elaborate as much as necessary.  Don't hesitate to ask.

I filed for custody of 10 yr old son & contempt charges against ex-wife.  She is retaliating in numerous ways.

She has gotten a temp restraining order (pending court date in 8 days) by making completely false allegations against me.

How do I defend myself against totally made-up incidents and accusations?  Since she has no regards for honesty or truth, what will stop her from doing this over and over again?  Is there anything I can do other than deny everything and hope they believe me over her?

Please respond with any comments, experiences, questions,....anything would be helpful at this point!

I am looking for information or knowledge of home-schooling in regards to custody.  I have put up with so much nonsense from my ex and kept quiet for the sake of our child's peace of mind, but it has now gone too far: she has secretly taken 10yo son out of school to home school him.  (We have joint custody)  Without going into all the details, I will give one example. She said that the judge did not know what she was doing by giving me so much time with son, so she would deal with it her own way.  And she has dealt with it many many times by keeping us apart, alienation tactics, false acusations, etc., but this is the last straw.  

Would changing from public school to home school be a significant change of circumstance to justify change of custody or change in visitation?

Also, I have heard of a case in Etowah county Alabama (i'm in AL) that was just filed for similar reasons.  Does anyone know how I could find out more details about that case?

A protest in support of NCPs was held outside the courthouse in Birmingham Alabama.  The good news is that it happened at all.  The bad news is that there appeared to be only half a dozen peolpe there.  

Any start is a good start!!
