I w/ try to be brief. This is about my nephew.

He got sentenced to 5 yrs FEDERAL prison. While he was waiting for his hearing/sentencing he got a DUI. He was in county lock up waiting for a *spot* in fed. Federal marshalls turned him over to a state lockup which is now NOT counting against his federal sentencing time. Lawyer is going to file a notice of illegal imprisonment.?

Is he being flushed down the bureaucratic toilet? I am fearing for this happening since it does so freakin easily.

That's just it Soc....NV doesn't have any order, it is only enforcing the NJ order that NJ created.

Stipulation w/ the kids is that Mr. Jola be given proof of school enrollment on a quarterly basis and he hasn't received any. She should be scheduled to graduate this May but, we don't have proof of that because the Mother failed to provide proof of enrollment.

We are in the process of filing our stuff in NJ, since that is where the court order has resided since the original divorce. Kids still live there.

Mr. Jola got a letter from CSE in NV stating that he has missed a payment and that this is in pursuant of the NEVADA held court order.

How do you suggest we word it so that NV doesn't think they have the order?

AND if they do want the freakin order, NV emancipates at the age of 18 and Mr. Jola has been and is paying for the 2nd 23 year old. geezuz....Are you sure I can't borrow your 5 year old? Cause this shouldn't be this screwed up.

PS - we are filing for emanciaption of the 23 year old since we never receive verification of school. An audit of the account. What would be the best wording for the other crap?

MY suggestion to Mr. Jola again, on what you say is get it before a judge..do you suggest NJ? PLUS, the oldest person on the payroll is gonna be 23 in oct and should graduate college in May. we have NO proof since the xmommydearest refuses to confirm  college enrollment.

we live in NV.
refinanced our house last fall and was forced to pay NJ 26K in blood money. NV had a judment against Mr. Jola for 11K and said they would release it once the 26K was paid.
It was, and voila. Mr. Jola lost his job and NJ states his arrearages are now 900.00 bucks. NV refuses to release the 11K judment against him until he pays the 900 bucks.

Is there some sort of interstate something stating that judments can ONLY be placed for a certain amount of CS arrerages?

If so, can you please direct me to that?

NV still shows a lovely judgment against Mr. Jola for 11K even though we paid the blood money of 26K to NJ after NV said...HEY we dont' want to take any money from you....

you keep up the fight and Rachel will love you as the good Dad you are! Way to go! I can't say enough...Keep up the fight, it's gonna be a long row to hoe, but, I believe you have the gumption to keep it up!
