My first husband had a garnishment on his name. I had to file and injured spouse form every year WITH my taxes so they wouldn't touch my money. It takes a bit longer to get your refund back but at least you get it.

That was your counter paperwork?
If it was, anything you want, needs to be in there. WRITTEN. Tell them to add it.

Fax her back,
Please add these two lines:

Father will claim children in even years if he is up to date with child support as of Dec. 31st. Mother will claim children in odd years.

Father will have vacation time with children (be exact with dates and times if possible) from day children get out of school at 5pm until July( or Aug) XX at 7pm.

Yea, that was the paperwork.  She asked to be reimbursed for his attorney fees and such but didn't mention vacation or income tax. I'm beginning to seriously question her. If we lose at this go around, we are so done. We will take what we have and just be happy. It just isn't worth paying this attorney to do nothing, which is what I feel she is doing. Maybe I'm being too hard on her but when I pay someone that much money, I expect to be treated like I am her only client. Know what I mean? Instead, you can never get in touch with her, she never returns calls, etc.

I will be so glad when this is over.

Father's Issues / Re: Standard visitation?

We are pretty much demanding 50/50. We only like four night a month for that happen and she willingly give us two of those ( and has for a year) so we just really need to have 2 nights a month added. Her leaving the county was the ONLY reason the judge didn't grant it before. Now she is back. Should be cut and dry. Yeah right..... Our attorney is out today as well but we did get the secretary to fax us the papers to read over. It is a counter-petition for modification. It didn't state anything about vacation or claiming every other year on taxes so I called back and asked if that needed to be added. No word yet. I swear, attorney's are horrible.

Father's Issues / Standard visitation?
Mar 14, 2011, 05:02:19 PM
Is there somewhere I can go find what "standard" visitation is in TN? I am curious mostly about what is standard for summer visitations and such. One week? Two? Just trying to find some things to throw in the attorney's face tomorrow.

Left work in time to get to the attorney's office. Thought maybe we should call first, even though they don't close at five and we had plenty of time. No answer. Go figure. We turned around and went home. Tomorrow morning we will call and make an appointment I guess.

I get more disgusted as each day goes on. How do you keep the frustration from taking control?

Sadly, I can't explain much of anything that happens in family court. You just sit and wonder what the heck they are thinking don't you?

General Issues / Re: Pigs DO Fly!

Good to hear.  Sometimes I think our pig will never fly. Gets frustrating but it sure is good to know things are working out for someone. I keep looking forward to the day it happens here.

That was sort of hard to follow but if the kids get taken wouldn't the grandmother be the first to be offered guardianship?

I really do not like your lawyer. He can go in there and fight tooth and nail for the tax credit every other year if you are up to date with your child support.

What is going on with the child support? Are you behind? Is she asking for more? When the judge said that your lawyer should of said "my client is up to date and paying according to state guidelines while the other party is harassing him at work"

I get THIS judge may not give certain things but he can fight it out...sounds like he is telling you to settle...

Our attorney is a woman and I do agree that she is telling us to settle. It just seems like she is laying down and giving up this go around. We are going Monday to sign some papers. We aren't sure what they are, we have never had to go sign papers ever since we've done this. I am seriously thinking of telling her that I feel she is not fighting.

Thanks for replying.

I tell ya guys, sometimes we all need words of encouragement or just a short note saying someone understands. Is the board really this quiet and slow or does no one have a response? I'm being petty, I know but I was hoping for something more than nothing.
