Ok, beside the fact that everyone is right that I should not put a lien on my home, I do understand, ...

I am looking to put a lien on my home per court order.

In short, if I want to go on vacation with Kid to Europe I need to post a lien on my home for 20K.

Question is how do I do that?
I am in Minnesota.

The idea is that the lien papers would be writen but I would not register it with the state and when we return per court order the lien is waived, ...

Bottom line is I am looking for a Lien form, ....

anyone ?

Ok so here is the facts:

- want to go out of country for 2 weeks with our son for vacation
- ex is asking the court to order me to place a bond of 50K for surety.
- I am in the process of buying a home so I have the 50K in a saving but by the end of the month this will go to the down payment of the home. (before we do the trip in september).

question:
what can I show the court that would be sufficient for them? The purchase agreement? but this does not show the down payment or equity in the home, ....

any ideas ?

can you file a motion for contempt while you are waiting to go to court for a hearing on another motion


so I have motion 1 in court mid July.

However today AGAIN I got denied parenting time so I want to file for contemps, .... do I need to wait till after the mid july court or can I file it before with a court date after ?

ok so let me paint the picture:

- Our son and I has familly in europe (note we are all american anyway)
- we weent to europe in vacation before
- I asked ex to give a written approval to go this summer as per our court order
- ex refused, and denied mediation
- I filed a motion to authorise me to go to europe with our child (not heard yet)
- I had a friend mail ex and her attorney the motion and papers certified return receipt and done affidavit of service
- Ex and I have a mutual agreement not to go by each other's home, ... mutually agreed restraining order
- the letter had my address as return address so I would get the return receipt
- Ex contacted me (on the only agreed way: by a web site) to tell me that she received letter but decided not to open it as it violate the mutually agreed restraining order (note the order doesn't say I can't mail her anyway).


So from my point of view, I served her with the motion, her attorney as well, filled with court, she even tell me she received it BUT refuses to open the letter, ...
Do I need to worry?

what is going to happen in court if she does not show up ?
I also have proof that her attorney of record received the motion, ....

any insights?

Court order and divorce decree state that we are not to take the child out of our state and or abroad unless we have writen agreement stipulated to the court or a court order.

So I asked ex to agree we could go abrboad see familly, she refused (not even asking anything). We did mediation and she refused as well.

So I want to bring a motion to the court for this and have the court gives us approval to go abroad.
What is the name of the motion I need to make?

I have been accused for the past 2 years of countless false accusations from my ex, she repeatively call the police to make false allegations, ...

anyway, after 2 years of countless proofs and tape recording, I do want to file a formal complaint to the state.

Who do I need to contact in my state to file complains after her and possibly have the state sue her, ...

My storry is quite long but I am gona try to explain here.

A long bitter divorce, .....
My ex has the habbit of filling stupid law suits and defamatory letters after me.
- I am not a US citisen so she wrote to the Imigration and made things up to get me deported.
- She called the pollice several time and asked them to arrest me based on false allegations, when the police came I showed them the order and they dismissed her claims.
- She said that I kidnapped our kid after a trip to europe, ... our judge said there was no contempt and in her findings find her (my ex) to have lied and untruthfull, ....
- Lastly she filed a harasment order so I coul;dn't have contact with her and then call me ask me to come pickup my son (which I didn't till the order was overturned), ....

these are just a few examples. I have her on tape, ... I have the letters she wrote to the INS, ....

I am not interested in filling a defamation suit but I have a few friends that told me to go see the state attorney and ask that he files charges against her for repeated false statement, calling the police for no good reasons, ...

can someone talk to me about this? what can I really ask?
I just want them to charge her with something so she stops making these frivolous claims, ... what can be done ?

Ex filed an harasment order on me.
Order was granted temporary and we are due in court next week to discuss it.
I am going by myself.

- The order state that I am not to have any contact what so ever with her.
- stay away from her home
- stay away from her work
really I have no problem with this but the fact that I haven't been able to pickup my son as a result of this, ....

ok so divorce is really bitter with my ex and we have a son together.
we are divorced however her mother and her boy friend always have their nose in our stuff to try to "get back at me"

Here is the bottom line: they are REPEATIVELY calling the police for nothing.

Her mom come to pick our son, we are 2 minutes late she calls 911. When we arrive outside, she is faking a "no don't hurt me, ...." I had a tape recorder that eventualy the cops that came heard and dismissed.

Today I pickup our son and she isn't there, just the BF. I give him a coupon to give to the ex and he refuses, doesn't want any papers so since it's her place (not his) I put it in the mailbox and here he goes, "it's a fellony to monkey with mailbox" and he goes again, calls 911 and get the cops on scene (I left, didn't even stay for that one).

over te last 2 years between the 3 of them (my ex get at it sometime) they called frivolously the cops a woopen 37 time (I counted). Most of the time the cops don't do even a report or refuse to do a report as this is "family matter"

But this is getting really old, what can be done ?

my ex put my son at a new daycare and refuses to ell me where till we are done with court.

We are already in court for other stuff so no need to file more court papers but I would like to know where our kid goes to daycare.

Divorce decret says that in case of parenting issues, ... we can use mediation.

Beside the fact that we have a motion for Contempt that is going on, we have some things that need to be cleared out in our divorce decret and I want to start the mediation process with my ex.

But where does it starts?
Can I just call the state and ask them to be a mediateur ?

I am watching the practice tonight and there is something that rises my question:

The DA makes advance to the attorney that her client get 6 month if she has sex with him.
the attorney tells the stuff to the judge but then the DA says I never made advance. she did, ...

In order to prove civil contempt, your opponent must show clearly and convincingly that there was a valid court order in place, that you knew of the order, and that you willfully and with conscious disregard, violated the order.

I was given this sentense more than once as to how contempt works (as far as for the judge to take a decision)

What are your toughts on this? what's your experience? is it true (really for once inocent unless proven guilty) or is it the opposite?

what can you do when a parent has a passport for the child (US passport) yet won't give it to you to use?

Divorce decret doesn't have any limitations on out of state, ...

is it possible to obtain a copy of the pasport so each parents have one for the same kid ?

what can be done after an ex that keeps trying to take you to court for reasons that are simply dismissed??

Everytime we go to court it's 3 or 4 grands and she goes at it every 6 month for a reason or the other. everytimes, court dismisses her case but she play the poor woman and never get to pay attorney fees therefore she keeps doing it.

This is getting to be a pain, ... Any actions I can take ?

Some of you might know my case, regardless, my question is more "general".

When there is a civil motion for contempt after you and the referee decides that you are in contempt.

What them? does he grant their motion as an all? does he look at every points and only order which ever ones that makes sense and dismiss the others, ...???

Ok so now apparently my ex is going back to court to get another "order to show cause" against me (note she already has one) but apaprently she is changing her motion to add that I be held in contempt, .... ????

I am lost as to what she is trying to do ?!?!?
Why not add this to the first order ?!?!? this is the same court date, ...

Also the referee we'll have is a long time lawyer in a big firm that became a referee last november.
Can I expect her to be "by the book" as she is new to the referee role or totally biaised ?


She is an American Indian (origins) and I am wondering what American Indians think about dads ??? do they think a young kid need a dad only for it's child support or do they think that both parents should have 50/50 ?!?!?

Never sign anything the custody evaluator asks you to sign - even if it's a scrap of paper that states you agree to XYZ conditions. This is a trap. Anything you sign becomes a bona-fide legal document that will be used against you in court.

they are asking for proof that I am paying and supporting my kid.
I have CS witholded on my paycheck, is this enough to show that I support my kid??
