Trial has been continued today.  Yesterday started out bad, but ended good!  Judge stated that the court now understands that both parents are good parents.  Also threw out all contempt charges against Will.  
Today will be hard, they will each have witnesses there.  Former friends, neighbors etc.  PBFH got caught lying yesterday too, hope he can persue that today.  

The not so good news is that she has always been by defenition the Primary caretaker and Will feels that the court will want to maintain that despite the move.  Just the feeling he's getting from the judge.  

Opposing councel questioned him about why we are not married and are we engaged?  She tried to say he lied on Dr.Phil.  Judge got a little irritated that she was pulling that goofy stunt and put a stop to it.  

I'll know tonight the outcome and will let you all know ASAP.

one point to make though - the not being married and living together may end up being a major thing too.  Sometimes that is considered not to be the ideal situation for the children to be living in. Many divorces have moral's clauses that state this. They could try to make this an issue depending on the outcome and use that as a way for her to retain custody.

Or they could try to say he shouldn't have overnight visitation b/c of the living situation.  

Things to think about. Depends on how much of a big deal they want to make of that and use it for. I'm just stating this b/c they brought it up right away.

since you're in the court house anyway, why not run downstairs and get married just to shut them up???

LOL!  Our relationship means more to us than a Justice of the Peace.

Yes I know, but sometimes you gotta give in.  Hubbie and I were together 3 years before we got married.  His Ex refused to have the child come to our house because we were living together.  And the court supported this.  Thanks FOC!  See post on Michigan Santa's to learn more about the FOC.

I know this is hard right now, try to stay positive.

That the judge knows that both parents are capable is a good thing.

The judge will have his decision in two weeks, no date yet.  Our witness showed up and testified to witnessing David physically abusing his young ss regularly and as a part of the group of friends at the time, Heidi was aware of Davids abusive nature.  The judge was also very interested in the pictures we got from a PI showing the exterior and surrounding land of the run down property in AK where the kids will live.  PBFH got caught lying on the stand a couple of times.  When asked about when her fiance at the time hit OSS, she would not answer "yes" , but just kept saying "There was no police report."  This all seems to weigh in Will's favor, but the judge also spent alot of time asking about how plane tickets for the children will be paid for.  OH Yeah!  AND Will's attorney knows the counselor the Dr. Phil show "paid" for and said a few years ago she was arrested for public drunkeness and that basically she is worthless.  

I'll let you know more when we find out!

You have to wait two more weeks?  "There was no police report" is not an answer.  Then again, a good judge will note that response.

Well, on the upside, two weeks is a heck of a lot better than 90 days.

But the waiting still stinks I'm sure.

Hopefully the Judge will see through this mess!

When PBFH was on the stand, she tried to announce what a great mother she is by saying that ever since 7 yr old was diagnosed w/ADHD, she has been even more involved on an educational level.  Well, she never told Will he was diagnosed or that she ever even took him to the Dr. and that it was a possibility.  The judge was none too happy that she did not share this info with the other parent.  Basically, PBFH did alot of back pedalling and her two witnesses that showed up, judge did not seem too impressed with.  
The newest development is that she had Will's wages garnished and he has never not paid, in fact for a while he overpaid.  We are trying to find out if she can do that with no notification or hearing.
