recording telephone conversations of a minor

How do I find out if it is illegal to record phone calls of a minor - my step daughter.  She ran a way recently and we have over heard her lieing to her friends about being abused at our house.  Custody is split 50/50 but the ex filed for custody within months of the last determination.
