Is there a light at the end of this tunnel
« on: Aug 04, 2006, 11:20:14 AM »
I have not been able to have access with our boys for two years eight months. I do pay child support, and have never been late. I am on disability for my back and am awaity surgery. Going through the divorce she made accusations that I had molested my nieces. I know it is not true but you are guilty until proved innocent in family courts. Nothing ever came of this accusation. The last time we went to court the judge advised my X and me to go to a mediator to see if we could resolve this through them. The judge did advise her to put the house on the market. We met the mediator, my X, her attorney and my attorney were at the office and I was on the phone with my attorney. She wanted the house and for me to have security visits with our boys. I guess the judge thought that she would change her mind. Well my X had also Appealed the first ruling when her second attorney and her did not show for the final hearing. We waited and after about two hours the judge asked me and my attorney to go up and asked me what I wanted. My attorney wanted me to take everything but to me that is not fair. So I said fifty/fifty that is what the law is. Also that I have custody of our boys but it would be joint custody. I tried to pick up the boys with the counstable but the order did not have in it: "You may use force if needed" So she called her attorney and there was nothing we could do until the appeal came back. My attorney after the mediation meeting advised me that she could no longer help me because she was not an appeals attorney. Well the notice came back in my favor that she withdrew the appeal but for some reason the case has been closed. Can I order a new hearing so I can see our boys? Also is the MMPI2 the same test for chronic pain and custody cases? Sorry so long but needed to get you up to date. Thanks for having this site. Is there light at the end of this tunnel?
