I am preparing for a pretrial and one of the things that I know I will be up against ids that the STBX says that she spends a ton of time with the kids.  Realisticly she only spends one day a week and only a couple of hours at best then,  with the kids the rest of the time is spent with a babysitter.  She is currently working three jobs from 6:00 AM to 10:00 PM.  My attorney says he can't supiena the STBX work records but I need to prove that the STBX doesn't spend time with the kids.  How?

Also what can I expect at a pretrial hearing?

Via discovery, you can ask for her to produce all of her paycheck stubs, which should show total hours worked for certain time periods.

Your attorney can depose the babysitter to find out how much time the babysitter cares for the kids.

You can hire a private investigator to document how your ex spends a week.

If you want to really blow her out of the water, get OPTIMAL. It also allows you to put time in that neither of you have with the kids, like school. Great program and colorpacked graphics.
