In general,if it isn't spelled out otherwise, you can cross state lines, especially given the short distance.  Our case is IL and grandparents had visitation rights in place of DH because he was overseas for 2 years.  Ex tried the same thing and would go to court.  Judge finally got tired of it and told her straight to her face that the GP's can go ANYWHERE in the WORLD as long as the child was back at the correct time.  That is the last time the ex tried that.

Advice I was given when a letter is received is to mail out the letter again(for us it was certified) and mail one out by regular mail.  If the certified is refused staple it with all the receipts, etc.  Get a copy of the receipt for the one mailed by regular mail(take a picture of you dropping the letter in the mail box at the post office-make sure you get the address in the picture.)  If you don't get the regular letter back, then notate that it was received(you can get a confirmation request from the post office.  All you do is call, it doesn't have to be signed for).  If it is sent back, then she would have had to write "return to sender" on it and it would show she had received it.

DH has his DD every spring break,
every other Thanksgiving(rotating with every other Christmas Break),
and every summer(minus 1 week after and 1 week before-but for only 8weeks).

We will be going back to court soon to get weekend visitation for everytime BM and DD are in the area.

Unfortunately the wording is very vague.  You may want BM to come to you, but you may have a major fight on your hand.  You may have to look into going to court to ensure everything is spelled out in detail about when, where, how and include dates(if possible) and times.

We are in IL.  Our order is for 8 weeks, as long as we don't take the week after school lets out and the week prior to school starting.  We did that for 04 and it was fine, ex begged to let her parents come up for a visit and we said no.

This year SD asked to move visitation bacause she wanted to go to school parties held after school let out by her friends.  We said ok, and ex agreed to allow us to have SD the 8 weeks, ending the Sat. before school started.  Fine, but we found out, SD didn't get to go to any parties, ex sent her daughter to her parents for the 3 weeks prior to our pick-up.  Now we know for next year that this was a complete fabrication (or at least SD was denied the parties we agreed to) so we go back to the order next year.  We will have to go back to court though, ex won't agree to stop-over flights(which we are allowed) and she won't agree to times.  

Make sure you have set dates(such as us with excluding the set weeks).  Mode of transportation and times for pick-up/drop-offs scheduled for each type of transportation.

Alot of times, summer visitation length is determined on the age of the child and how much time they get to spend throughout the year.  We started with 1 week and went to 2, then 6 weeks and now our 8 weeks(SD is 12 now)

I agree.  I would make sure a copy goes into your court record too, to endure it is in the file.  As it is BM's birthday, and son is 11, it may be a big deal for both.

Just let her know there WILL be a make-up day and stand ground on it.

Custody Issues / RE: Proving alienation...

How do you try and counteract it?  We try to call 2x's a week when we can, but the talking is rather stilted, SD gets pumped on the conversations and she can't say 'I love you' with out getting in trouble.  If they go out of town or to family (near us) no phone answers, the voicemails aren't returned and no anwering machine will pick up the entire visit.

We keep up emails, but there are times she won't check it.  We got her a web cam, but she's not allowed to use it.  We were sharing a yahoo calendar, but she isn't allowed to do that.  We try to send a package out especially during holidays, and they don't pick it up til way later, and in the case of SD's 8th grade graduation, it they never picked it up and came back to us.

When SD had to take her first lay-over flight, SD freaked out for a week, mom told her she was going to be lost and all alone and that once SD turns 15 they won't take SD as an unaccompanied minor any more and that she will really be alone.

What else can we do?  We are going to start a family web page so SD can go and has another way to stay involved with us.  I am hoping to try and start scrapbooking with her (I have never scrapbooked before!!!), but it is something she loves to do.

Anything else?
