I live in Kansas, Not California so I can only Give you what I experienced in Kansas. I was in the same situation, I was in court trying to get custody of my Children. The final Decision was they looked at who was the caregiver, Finances really had nothing to do with it. Since I was the one that worked and made the money to support the Family, She was the one that stayed home and took care of them, She was given Primary Custody. Afterwards she found Numerous Boyfriends, Moved the Children often and was not concerned about their education, I went back and received Custody. More Courts are starting to give Custody rights to Fathers then before. Hope this helps.

Im in Kansas so 18 is the Legal age to become an adult. The Custody order says after Graduation is when child support is suppose to cease. She is also trying to get the Child Support ordered changes. He graduates in May, It will be well after that before we can get a court date. The child support is very little so I dont have a problem with letting her keep that.

The 13 Year old is doing great is school, She does not want to go live with her mom because of friends in school and so forth. The children are very close so this may be enough to change her mind, and Mother has been putting stuff in her head as well.

My son Turned 18 in November. He decided he wanted to go live with his Mother because I Grounded him for having bad grades his Senior year of High School. I am rather Strict on Grades but when he is a Senior and Failing, I feel like it is my responsibility as a Parent to get him Graduated. Anyway, We also have a 13 Year old Daughter that I have custody of. The Mother had her Attorney Contact my Attorney and request a Modification for the 13 year old to live with her Because the Children to to be in the same home. 1) When a Child turn 18 he becomes and Adult, It was his Choice to move out and I dont think this has anything to do with the 13 year old.  2) Him turning 18 and Moving was part of the Plan from Birth, IF he is 21, Married with Children, Would she still want them to be together? 3) I dont think him Turning 18 is a Material Change in Circumstance for a Change in Custody. Whats your thoughts?

I had this problem also. It always seemed to help if I would throw in the words "My Attorney could contact you if you would like.". I never had any of them say yes, please have him contact us. lol.

Custody Issues / It is Possible.
Dec 23, 2015, 06:25:03 AM
For those of you that have been following my Custody issues, I want to thank you for all your help and support. I Got the written orders from the Court yesterday and after a 3 year battle of trying to get custody of my children, I finally got Custody. At first it was very emotional, Financial and Stressful situation, But after keeping 3 years of Text Messages, Facebook, Grades and Emails from teachers, I finally got it done. I know that this is not the end of all my problems because I do know how my Ex feels because I have been there, But I can say that I am prepared for it.

No you don't lose CS for filling Custody. Child support is usually a formula of how much time one parent has the children and the amount of income the Parents make.

Custody Issues / Re: What does that mean?

Thanks for all your info. Another question I have is, If she admitted to Child endangerment on the stand and admitted that she left the children in the abusive relationship for 6 months before she did anything about it, Will the state step in and do something about it? I know the Judge will take this into account in the custody issue, But can she be charged with it?

Custody Issues / What does that mean?

For those of you that has been following my posts, we went to court today to get custody. At the end, the Judge looked at ex who has custody now and said "I need to review this to make sure the kids are never put in this situation again". What does that mean? Does that mean he he is goin to let her keep custody and make it where she can only do certain things with the children, or does that mean he is going to allow me To have custody and write it up where it can not be appealed. I will be waiting for the verdict for sure. How long does a Judge usually take to release a written verdict? The last one was verbal after the hearing.

Custody Issues / Re: Seek in Court

If you are seeking Primary Custody, Chances are, someone will receive Primary custody. I suggest have a great case with great documentation as to why you are seeking Primary custody. But you really never know what the court is going to do until its over.

I have gone through the same deal. Like stated above, I would not worry much about court right now, But I would start getting prepared. Keep in mind, Don't wait to long, if you do, they could already be moved and living there before you go to court. 1) Do all that you can for your children, The Judge is most likely to make a decision based on two things. Who is the primary care giver of the children and What is in the best interest of the children. 2) Document everything. If you can communicate VIA Email, Text or chat, that is the best way to show proof of your point when you get ready to go to court. 3) Do not underestimate the other parent, If she is planning on moving already, Don't be surprised in the next few months you get a letter saying that she is moving in a week.  Best of Luck to you.
