If you or someone you know is a victim of government corruption (including family court/law) and would like to be interviewed on video for an upcoming movie and congressional testimony, come to Residence Inn on Shackleford Rd in Little Rock around 6 p.m. today and ask for William Windsor's room.  The movie title is Lawless America.  The collection of 3-minute video testimonies will be delivered to congress on January 9.  For more info see www.lawlessamerica.com or www.Facebook.com/lawlessamerica. To Coppertop or anyone else in support of CPS and foster care:
You're right about some parents choosing a selfish lifestyle of alcohol, drugs, etc. over their children.  My brother-in-law and sister-in-law in the above case were addicted to drugs for several years and probably did neglect their sons.  A couple years ago they finally got off drugs and were baptized to become Christians.  Last Summer CA DCFS flew our nephews to Arkansas and returned them to their parents.  Their last foster mom was an abuser and sociopath who abused and tortured them, but eventually was caught and prosecuted.  The oldest boy (14) incurred so much damage and mental issues that he wears diapers, is in an inpatient adolescent psych facility now for treatment.  You're wrong about CPS always giving parents ample chances to shape up and reunite.

      Apparently my wife's ex-brother-in-law kicked our 16-year-old nephew out of their house in Indiana (suburb of Lousiville, KY) because he didn't like his son's girlfriend and didn't want them to see each other anymore.  This Summer he offered for us to take the younger 14-year-old nephew, who got into trouble with the landlord and school.  Then the dad sent him to live with his grandparents. (These are different nephews than our other, younger two who are in foster care/guardianship in CA.)   About 9 years ago the nephew's dad/my wife's ex-brother-in-law won custody from my sister-in-law who left her other son in a mental hospital in Little Rock.   My wife was close and like a mom to our oldest nephew (homeless one) when he was little.  My wife, her sister and parents haven't seen either boy until I found them on My Space and we drove up and united with and visited them this June and Labor Day weekend.  The 16-year-old dropped out, was expelled or suspended from school and was supposed to be working on his GED.   In addition to him being in a gang, we're concerned about him having the basic necessities, including a place to live.  In the few weeks since his dad kicked him out, he has stayed with friends, his girlfriend, grandparents, in vehicles and outdoors in a park, but sooner or later he might wear out his welcome.  Hasn't the dad criminally abandoned or neglected him?  My wife tried calling to talk to the dad or stepmom but their phone has been disconnected.  In the last year or so they have moved a few times.  So we don't know the current address.  My wife stays in contact with the oldest nephew through cell phone and his girlfriend.  We don't want to involve CPS/DHS because they would probably worsen the situation and may cut us off from our nephew(s).  Lately we've been seriously considering emancipation or the oldest nephew coming to live with us, but we're already broke this month.  So that we could enroll him in school, consent to medical care, his employment, and otherwise have loco parentis authority and control over him wouldn't we need an Indiana court order giving us custody, foster care/parenthood, or guardianship?  I don't think just a simple written consent from the dad will be sufficient.

       Hi.  I'd really appreciate advice or opinion on our situation.  A few of you may already have heard of this case.  My wife's 6- and 10-year-old nephews were taken by CPS (DFPS) in Houston 3 years ago after my sister-in-law publicly blamed their older son's abuse and lack of special education on his school.  My brother-and-sister-in-law were suspected of drug (ab)use, "erratic behavior", risk of harm, and my oldest nephew of truancy.  Although forms were filed, hearings held, and a "family service plan" imposed, their Constitutional, parental and many other rights have been denied because their sons were taken before and without adequate evidence and no conviction or verdict of "substantial harm."  My sister-in-law is often so dramatic or exaggerant, incredible and manipulative that we can't depend on her or what she says.  I've seen her in action.  I tried not to have anymore to do with them after she made a highly offensive but false accusation of me and then they illegally recorded my and my wife's phone conversations in 2006 when I stayed at their home.  After our nephews were moved to and from a few foster homes my brother-and-sister-in-law (our nephews' parents) agreed for his ex-sister-in-law and their "sugar mama" in So. California to take custody of their sons as a foster mother/(permanent?) managing conservator, just to get them away from CPS and its foster care system.  She is single, wealthy, a paralegal for a prominent law firm, founder of the annual Candlelight Vigil For Children, active in a prominent children's rights organization, and a "control freak".  She and Judge Van Pelt in Houston wouldn't allow my wife, her parents (our nephews' grandparents) or me to contact the boys or send them gifts. As far as I know the CPS case has expired or terminated.  In the two years they've been in her care she (their current foster mother/managing conservator) has been maliciously and ridiculously limiting phone contact between our nephews and their parents from mere minutes per week to no contact unless and until the parents (my brother-and-sister-in-law) meet her crazy demands.  My brother-and-sister-in-law claim absurdly that the foster mom has told the boys that their mom, grandparents, my wife, our son (their cousin), I and the rest of their family are dead, that she told the boys' current school she is their mom, that she wants my brother-and-sister-in-law to divorce so she can marry him (her ex-brother-in-law), and for he and my sister-in-law to tell their sons that the rest of their family is all dead.  She wants everyone to recognize her as the boys' only family and parent. If true, of course that's abusive, fraudulent, incredible and pretty severe PAS. .About a year ago the boys were returned home briefly, but the oldest one caught the house on fire. Even though the fire was determined by CPS not be my brother-and-sister-in-law's fault, their sons were taken away again and given back to the foster mother/managing conservator in CA.  (My wife has spent time with her in the past.)  My brother-and-sister-in-law have apparently been off drugs around a year.  They both moved back here to Arkansas, about 50 miles East of us, last Fall.  The foster mom/managing conservator refused to let my brother-in-law visit his sons in person when he was in CA last Fall for job training.  The foster mom is planning to adopt the boys and TPR their parents pretty soon.  My brother-and-sister-in-law, my wife and my parents-in-law have begged me to let my brother-and-sister-in-law come to our house for holidays and when their electricity has been out, and to file for conservatorship (custody) of our nephews.  Just in the last few weeks I have decided to relent, be friendly, talk and associate with them again. They invited us out to eat and visit the weekend before last.  I didn't appreciate my sister-in-law pressuring me to take our nephews or she would no longer consider them hers.  They want us to get conservatorship/custody of our nephews and then give them back their sons on an on-going visitation basis.  My sister-in-law claims that CPS (DFPS) wouldn't challenge, evaluate, or over-see us since it is no longer a party, and that she has an attorney ready to change jurisdiction to Arkansas once the boys get here.  My brother-and-sister-in-law say they don't even have the more recent court documents and orders.  I'm not sure if Harris Co., TX, or San Bernardino Co., CA, has jurisdiction. At this point the foster mom could change the jurisdiction and venue to California, if she hasn't already. Supposedly the police have been to the boys' and foster mom's home and the boys' school many times (for I guess disputes/disturbances); they are against the foster mom and are willing to help my sister-in-law get her boys back.  What a soap opera, huh?!

        I want them to have their children, as every parent has a right to, and for me to really be able to be their sons' uncle. I don't want this controlling and cruel non-relative foster mother to adopt our nephews nor for her to retaliate or otherwise cause us problems with her issues and resources. She provoked the situation 3 or 4 years ago by telling my sister-in-law to accuse the school, which caused CPS's involvement. I don't want any more legal trouble since my, my wife's and our son's issues, needs and problems are plenty to cope with already.  My wife and I decided to file for intervention and conservatorship of our nephews.  I've been looking up and printing out Original Petition and Petition To Modify forms on //www.TexasLawHelp.org and all the laws cited in them.  Now I need copies of, or at least to see, the rest of the case file, a Motion To Intervene In A Suit Affecting The Parent-Child Relationship (SAPCR) form for Texas or help with what to put in one, and get input from experienced and knowledgeable people such as in this group.

      My nephews, 8 and 4, in Houston (Baytown) have been taken by CPS and put into foster care where they have been for over a year now. It all started at the end of 2004 with an ADHD/special education-needs / truancy situation with the school.  The local TV news covered that story.  Then the school saw the oldest nephew's bruised arm and (partially out of retaliation) called CPS who interviewed him and later with a cop removed him and his younger brother from their apt.  Since then we've had to celebrate their birthdays during supervised visitations at Burger King.  CPS and the court wants to terminate my brother-in-law's and sister-in-law's parental rights due to alcohol/drugs and abuse/neglect.  I certainly don't like CPS's and the court's assumption of guilt, refusal of all due process, other constitutional protections and rights, lack of evidence requirement, arrest or search warrants, etc.  The parents and the kids all have been appointed attorneys ad litem.

       Astoundingly, it seems due to guilt and stress the parents have or will waive their right to a jury trial, their parental rights, and consent to adoption or continued foster care! There's another court date soon this Spring, which I plan, and would like any supporters also, to attend. It's in Harris County, 315th District.  The whole case is set for dismissal by August 11 and then the boys probably will be either permanently adopted or bounced from one foster home to another the rest of their childhood.  CPS and my sister-in-law want the boys to stay with me and my wife, but my family already has too much to cope with and not enough resources and room to take care of them.  I've gotten copies of some of the court orders in their case just last weekend, but I may not ever know the complete details, evidence and facts.  Supposedly they have gotten off drugs and stopped drinking.  I care about my little nephews and our corrupt injustice system.  So I'd appreciate any links or material about CPS/TPR you may have or know of.

I would be glad to help any non-custodial parent to remove their case from county/state family court in Eastern Oklahoma to federal district court and invoke Constitutional/federal equal parenting laws, rights, and other state and Supreme court rulings. I have well-pleaded, well-supported and well-written federal forms that can be modified for your case/situation.  There is much case law supporting a person's right to file/sue and represent themself pro se if they choose.
Anyone is welcome to reply to this message publically or privately.  If requested, I can forward an 8-page e-mail containing more details.
 
In addition to individual cases, Indiana Civil Rights Council is coordinating and organizing a Class Action suit to be filed in each state soon on behalf of all non-custodial parents and victims of CPS, DHS, etc.  Volunteer Class Action Coordinators are still needed for about 25 (half) of the states.
