Ok, 1st off. My first post a few weeks ago, only got me bashed and crucified so I don't want to go through that again. I am not trying to buck my reponsibilities, I am mother, that got screwed out of physical custody by ex. I now have to pay him. have house for sale, but the amount here in NC is 1/4 of total bring home pay. I have cancelled my phone, cable, and waiting to sell my house. What happens if I truly cannot pay the $385.00 CS to ex. (by the way he makes 75% more a year then I do) Please only sincere replys. This is hard enough on me, I don't need to be crapped on anymore.

long story, i am mother kids 13 and 16 wanted to live with dad, judge granted physical custody to dad, still have 50/50 custody but I have visitation. Ex makes 75% more a month then I do. I am required to pay support to him, which I work 2 jobs now and will be unable to pay support to father. Can you go to court to fight having to pay support? I will have to sell my home just to justify not receiving child support from father..pervious we had 50/50 week with dad, week with mom. Dad paid support to mother based on his income being much higher.  Is there any justice to wanting to be a good mom?

Hello Socrateaser,
Divorce has been final 4 years, major custody battle. He has money I didnt. Two kids involved. We have joint custody, ex husband has physical custody.  Boys are now 18 and 15, but 18 year old will not graduate till May 07. My wages are being garnished, plus arrears. Question is this..Ex spouses income is almost  80% higher than mine. They are garnishing 40% of my income for support and arrears.  He makes $85,000  MORE a year then my $30,000 a year income.  Is there a point where the support would drop drastically or cease? His income could be even higher next year although mine will stay the same.  We live in North Carolina.

Thank you

Can you explain why I pay child support and it is not counted as an expense to me or as income to my ex, but alimony is?
