EX WIFE STOLE MONEY FROM ACCOUNT

Yesterday my ex just wrote herself a check to my account, that unbeknownst to me still had her name on it.  She wrote it for the full amount of my monthly paycheck, which is ALWAYS directly deposited to that account and posts on the 29th of every month.  I found out that she had drained the account hours before I went to get my money out to pay monthly bills, child support, etc.  We have been divorced almost 3 years and she has NEVER touched the account up until now.  I had absolutely no idea that she was on it as she has never touched it up until now.  We had an uncontested divorce and debt and asset accounts were split and agreed upon.  I know that the bank cannot do anything as she was still on the account, but is there anything legally that I can do, as technically she has no rights to that account anymore as we are divorced, and she is already remarried.  I have no money to pay her child support for this month and no money to pay my own bills.  I am meeting with a lawyer on Monday to see what can be done?  Is there anyone who knows what is done in this type of situation?? Can she be thrown in jail?  Do I still have to pay my support??

Hi there... sorry to hear that this happened to you.  Why didn't you remove your ex wife's name from the account after the divorce?  Better yet, you should have closed that account and opened up a new one under your name only.  Doing that may have prevent all this hassle you're facing now.

I am no lawyer nor expert in these things so I can't advise on any legal action to take.  Good thing that you are meeting with a lawyer though.  Also, you might want to go ahead and obtained a copy of the cashed check with her signature on it and take that as your credible proof.

How do you remit your CS payments?  Directly to the Ex or thru the court?  If you send them to you, I would dock her.  If you're through the court, they won't recognize the money she stole as CS.
