I JUST WANT TO SEE MY DAUGHTER!!!

I HAVE BEEN TRYING TO SEE MY DAUGHTER. BUT MY EX-WIFE HAS KEPT ME FROM HER I HAVE SEEN HER 3 TIMES IN THE LAST YEAR. I HAVE TRIED TO GO AND GET HER WITH NO HELP FROM OUR LOCAL POLICE DEPT THEY DO NOT ENFORCE CHILD VISTITATION. I HAVE A COURT ORDER AND NOW AM FORCED TO FIGHT IT OUT IN COURT. I NOW AM TRYING TO FIGHT FOR CUSTODY OF MY DAUGHTER WHICH IS NOT WHAT I WANT I BELIVE A CHILD BELONGS WITH THEIR MOTHER BUT IF IT IS THE ONLY WAY. MY EX LIVES WITH AN AOCHOLIC AND A STERIOD USER BUT HOW CAN I MAKE THE COURT AWARE OF THIS SITUATION WITH OUT REALLY ANY PROOF. CAN I HAVE HIM DRUG TESTED ALSO? WILL THE COURT CARE WHO MY EX LIVES WITH? I LIVE WITH SOMEONE ALSO BUT SHE IS A CAREING MOTHER HERSELF. WOULD WE BE BETTER OFF GETTING MARRIED TO HELP ME WITH THIS? WILL IT MAKE MY HOUSE SEEM MORE STABLE? WE ARE PLANNING TO GET MARRIED BUT WE WERE WAITING, MAYBE WE SHOULD GO AHEAD AND DO IT? IF ANYONE CAN HELP ME!!!

Just a few small comments:

Do NOT try for custody if you believe she should be with mom.  That is not looking out for the best interest of your child!  

Perhaps a better option would be to flie for contempt of court against her for not obeying the current order.  When doing so, ask that an 'enforcement clause' be added to the visitation order.  That will allow the local police to do whatever needs to be done so that you can have your visits.

The only way to provide useable proof is to keep records. Get yourself either the Parenting Time Tracker (PTT) at: http://www.deltabravo.net/custody/tracker.htm or the OPTIMAL Custody Tracking service at: http://www.parentingtime.net. The PTT is good, but the OPTIMAL service is better.

In general, no. Not unless they pose a clear danger to the child, and to show that you need to have proof (see above about keeping records).

Not necessarily, especially if your getting married is seen as a move to make yourself seem more stable.

Again, start keeping records that you can take into court or an evaluation. Use a tool like OPTIMAL (http://www.parentingtime.net) or the PTT.
