Summer Vacation

Our final judgment (florida) allows us two weeks uninterrupted vacation time during the summer. I notified the other parent of the intended two weeks and he also sent me information on his two weeks.

I just found out our plans have changed and i wanted to relinquish the portion of his possessory period, that i had requested for vacation and request a smaller amount of time later in the summer. this weekend of his possessory period that i would prefer is actually a smaller amount of time.

1. how can i do this, since now he says he will not change a thing even though the new request is still 4 months in advance and does not fall on any of his previously requested vacation?

Unless you can come to an agreement with the other parent, or your court order permits some means of modification, then your only alternative is to file a motion for the court to modify the parenting plan.

And, I suggest that you will lose this motion, because it's you that has caused this issue.

In short, you're SOL.

i am sorry. i did not give you complete information. the weekend in question was part of my vacation request. on 2/26 i requested the time, but my vacation request was not in 14 consecutive days. nowhere in our final judgment does it state two weeks, nor 14 consecutive days.

only today did they come back with that they already have plans for that weekend... not mentioned earlier... like in february when i requested the time.

i only cancelled the june plans and offered that time back to them.

1. when sending notification for summer vacation dates (5 months in advance) can the other parent just continue to say they have plans for that weekend when such plans were not previously mentioned?
