Custody Opinion Needed

Here is my situation in a nutshell, I am looking for your opinion as to my chances for primary custody.

    My wife left me for a lesbian lifestyle. She took my son and, against his wishes, moved in with her dyke lover. He has expressed his distaste with her and has NO interaction with the dyke.

   I currently see my son 50% of the time or better. At my house he has interaction with new people and he feels comfortable with them. At her place he eats most of his meals in his room and there is no physical activity. With me we ride bikes, play basketbal, walk, etc...

   The latest was when my ex refused to make him available for Church. Case law in NY states that if it is in his best interest, she must comply. She is of a different faith and does not attend whatsoever. When we married, we had to promise to raise any children as Catholic, she agreed.

   My ex is clearly demonstrating that her interests are more important than his. There is a great deal more but I think you get the idea.

   What are my chances of getting primary? I am currently the secondary. I just want the change in title because I do not feel that she is capable of making solid choices for my son. Your opinion?

I'll give you a bit of advise,, drop the derogatory slang,, especially around your son.

Your ex's sexual lifestyle wont make a tinkers damn in court.
