I hired a lawyer just the other day, here is my case for a change of custody, Documentation of domestic disturbances from various police reports, suicide threat from police reports, guns were involved in one of the incidents, police escort to remove personal items from house. All of this within the last 6 months. Child has been seeing therapist and she recommends removal based on testimony of child and police reports that coincide with what child has stated to her. Witnessing fighting between mother and stepfather, to include physical abuse to the mother. Possible physical abuse to child by stepfather, he stated this to the therapist but without any kind of bruises or marks on his body, no real evidence other than child complaining of being hit and flicked on the head by stepfather. CPS was lied to by the mother about police reports, actually she just downplayed what actually was on the reports. Mother wasn't nor is she aware that I have the police reports nor does she know that I faxed them to CPS already. CPS investigator stated to me that what mother had told her and what was on the police reports doesn't conicide, she stated that the mother lied to her and that she would be confronting her about the lies and what is on the police reports. She failed to mention suicide threats. Mother is going thru a divorce with her current husband, they have 5 month old. Mother works 2 nites a week. She is also being treated for depression, this was stated in the police reports. I am trying to get custody of our 4 yr old. I am married, been working the same job for 18 years, wife has very good job, we have 2 children, stable home etc. Mother has not had a stable job in the last 4 years, at least 8 jobs that I  can recall. My concern would be her ablility to support a 5 month old, a 4 year old with a job that she works only 2 nites a week and from the support she would get from myself and her ex should he choose not to seek custody. From what I know he is going to seek custody, so needless to say my son's mother has a lot on her plate. What kind of chances am I looking at???
