Father needs advice.

I am in the process of getting a divorce. My wife has falsely accussed me of misconduct with her oldest daughter. The case was investigated for two weeks by the Police Department and sent to the DA. The DA said they were not going to press charges due to no evidence. Now we are supposed to go to court on the 20th of Jan. for the first hearing for the divorce.

I have been a stay at home parent for 3 years. My wife had 3 children when we met. She has joint custody of the older 2 kids, her 3rd child is living with his father who has full custody. She pays no child support. We have 2 children together ages 5 and 3. I have raised our daughter from birth. Now she wants full live in custody of our two kids.

Please help if you can.

Enjoyed talking with you in chat.  Just keep documenting any and every little thing.  If you can TAPE conversation, then tape them.  

Since the ex has been through this a couple of times already, she's probably a little more savy what to do.  Just don't say ANYTHING to her that can be used against you in court, because she could be taping you too.

If the DA is not pressing charges then they are dropped.  No evidence to support the accusation.  And the Judge will take it as that a "vindictive" accusation which will not look good on her part.

I agree with Patton. I also think this is just a spiteful act in order to put you in a bad light. Just as false RO's and OOP's are used. She will probably continue her games, so cover your a$$. Never go alone for exhanges. Bring a camcorder and camera, just in case.

I would also build a paper trail of you being the "stay at home parent". Doctor visits, taking care of the daily needs and caregiving.

She will probably have people assist her in her lies. Educate yourself as much as possible. Go into the search engine here.

I see the 3rd child is living with the father. Any chance you could have him testify on your behalf? He may have had similar problems with her.

Check the taping laws for your State. I tape regardless, if anything, it shows the attorney what is going on.
