Brother is thinking of 2nd devorce but is unsure if he can afford it... Living in a box in not his goal in life.

If father already pays 20% CS to 1st wife, how much CS will 2nd wife recieve?  is it 20% of Gross just like 1st wife or is it far less because father already had a child, and therefore the obligation, when 2nd marriage occured?

Thanks

First off....what State does your brother live in?

I know that in NC they will take into account a prior child support obligation and that amount will be entered on NCPs side of the worksheet. Also, if there is another child living in either household that is not subject to the child support order then a "credit" will be given for that child.

I recommend you check the guidelines for your State (or your brother's State if you live in different States). Also, have him get a free consultation with an attorney about this.

Has your brother thought about custody or 50-50 parenting?  Two seperate support orders are going to eat him up! Try //www.childsupportguidelines.com to see what he could be looking at. In addition, do some research (state codes!) to see if he would be allowed any other deductions that are not necessarily listed. For instance, in VA, the NCP parent could be allowed to deduct his/her student loan payments from income.
Good Luck to your brother.
