My boyfriend is going through hell with his ex-wife.  They had been split up and did "joint custody" for over a year.  They did the one week on one week off thing and each paid costs for the kids while they were at their house.   She got mad and threatened to take him to court very often.

Finally she did.  She took him to court and sued for full custody.  Neither of them got attorneys.  She, of course, won.  The judge did a modified every other weekend visitation (Thurs-Mon every other week, plus 2 hours on the opposite Mon. night.)  She quit a job making around 40K to work for her boyfriends company making 1500 per month.  She drives a brand new BMW and he just bought a brand new 50K truck.  He is a millionare and she lives with him as well.  She was awarded child support and my boyfriend is stuck paying 70% of all costs for the kids because she is "low income."  

He pays the amount she was awarded, as well as 50% of medical cost (all the sudden they go to the doctor a LOT more often) with no problems.  Just one month after the judgement came down, she was able to file an "Order to Show Cause Regarding Modification of Child Support Order."  Stating that the kids costs have increased and now the child support should be doubled.  

The problem is that she is calculating the form correctly, she is just being very deceitful about how much she actually makes.  Steve (my guy) brings home (net pay) only about $2000 from gross pay of $2700 and he is going to end up paying $970 to her.  What can we do?  Obviously we don't have money for lawyer.  She constantly harrasses him and calls himt "deadbeat dad."  Any options for us?  Or do we just pay and let her get away with the scam?

What state are you in? She's voluntarily under employed, this usually doesn't sit right with the courts. HOWEVER your boyfriend needs to prove that she HAS & could currently make the 40G's a year. Has he written his response yet? MOTION TO DISMISS! It should say in her filing just WHY it is costing more just a month after the original judgement. If it doesn't then that could be enough a reason for the judge not to hear it, but he has to file a timely response.
As for the b.s. she's spitting out, check your states taping laws, especially if she is doing this in front of the kids. Give her enough rope....:)
