how do you file for emergery custody

My husband and i want to file for emergery custody of his sons. Do we need a lawyer to do this?? The State is investing his x for abuse mental and phyical. We do not want to wate to they make her give them up or take them.

Unless there is a reasonable suspician that they will come to harm immediately, the likelyhood of getting custody PRIOR to the end of the cps investigation is slim.
