NJDad WINS!! - Receives Residential Custody Of Children!

Dear Fellow SPARCsters,

The Judge issued her ruling today in my hotly contested custody battle.


The verdict:  NJDad received primary residential of his four children.


This battle pitted my internationally renowned Family Law attorney Charles C. Shainberg, Esq. and co-counsel Helen Haney-Lafferty, Esq. against a couple of top regional Philadelphia Family Law attorneys. This case was cited as one of the ugliest divorce cases in area history. Though this case was not without its financial setbacks, the ultimate goal of moving the children to a safe and harmonious household was achieved.


At stake was the welfare of four children, 3 girls and a boy who are all under the age of ten. The mother tried to deploy the standard separation tactics of a TRO, a Criminal Harassment complaint, denial of visitation requiring a Visitation Order to be issued, misuse of Psychological services on the children without my knowledge or input, various financial games, denial of phone contact time, denigration of the children's father to various people, and worst of all filing numerous child abuse charges herself, and by third party sources including a false sexual abuse charge. Also, there was a failure to follow the Court's directives pursuant to the Divorce case, some eight months earlier.


Diligent record keeping, adherence to the Court's Orders, strong family and friend support, avoidance of alcohol or any type of CDS, maintaining composure, protecting one's self via voice and video recordings, maintaining a civil dialogue with the Ex even when she wasn't, and having a top notch attorney were all key to this outcome.


I would like to help provide assistance to others in similar situations as mine. I have seen many abuses and injustices in the divorce and child custody scenes and there are many areas that need improvement or overhauls. As time permits, I will be posting more detailed information about the ways my case transpired and the methods deployed to address various pitfalls that arose.

It must be a busy time for you and your children in this transition!  I hope it all works out in the best way for everyone.  It is possible that I too may be standing in the demolition zone of a custody battle.  It is for this purpose that I am replying.  Your brief explantion does not fully convey the turmoil and agony that you went through in the wake of false allegations.  I know, because I am there.  I am standing next to my husband that is being accused of everything from dressing his kids in hand-me-downs to battered ex wife syndrome ( they have communicated through letters for over three years now - no contact).  She has managed, however, to create quite an uproar with the children and finally my husband had no choice but to file a motion to change custody.  He has a really good case, a lawyer that I don't know how good he is, and many professionals on his side.  However, he is going through a most heart wrenching time.  He will be devistated if they lose.  He has had joint custody since 1996.  I was hoping that you or anyone that has been up against PAS and false allegations would give him some been there done that advice.  I wouldn't mind giving you my e-mail.  We are at stage one with depositions and such.  The other side are dragging their feet and it has already been 7 months and no trial date has been set.  If you get a moment would you lend a hand to a fellow father that is suffering from the torments of a disgruntled ex.

Remember, legal talent is everything. Contact the Family Court section of your county to see who they would recommend as a good trial attorney. Make sure they are members of the American Academy of Matrimonial Lawyers (aaml dot org).
