My X wife sent me papers on her intent to relocate. I tried to talk to her about her moving and she was very nasty and hostile and said there wasn't a damn thing I could do because her husband is in the military and he is being relocated to another state. I asked her to put myself in her shoes and what she would do if I was to move with daughter. She replied I would fight you in court.

So needless to say I did some homework and filed an objection to her relocation, modification in parental rights and responsibilities and motion for ex parte order. The judge signed the order to restrain daughter to the state of ohio. We go to court in july thankfully.

I want to know about summer companionship time. In my decree it states nothing about certain dates, times etc.
It states that Non residential parent's schedule shall have priority over residential parent's unless residential parent's vacation time is mandated by provisions of his/her employment (such as annual plant shut down). The parties shall give written notice of the vacation schedule at least 60 days inadvance.

This the only thing mentioned about vacation. So what should I do to have my summer companionship time.

Send her a certified with signature letter stating when you would like to have summer parenting. If she says no, then you have that as proof you tried and take her back to court for specific dates and time.

Should this letter be formal or just state thought I would like to have my parenting time and specify dates.

Keep it simple
Ex
"According to our divorce( court, separation) papers, I have summer parenting with child name. I will pick her/him up on XX at XXpm at what address. If these dates do not work for the children, please give me alternate dates by June 20th"
You

Get it signature requested so she has to sign for it and you can prove she got letter.

I am writing to you in hopes that we can come to an agreement for our summer companionship time. I would like to have " HER NAME"  as follows beginning on June 19 at 5:00 P.M. And ending on July 3rd at 7:00 P.M.. during that 2 week time frame you will have every other weekend starting at 5:00 P.M. And ending on Sunday at 7:00 P.M. And Wednesday's for your weekday companionship time. The same schedule should be followed when it is your two week parenting time also. If you should have any questions please contact me at.

What else do you have in your papers...2 weeks?
I would not ask her...State facts...and add the one sentence for her to give you alternate dates...

Does it say that she has visitation with the child during your visitation?  That seems odd.  The whole point of visitation is so that the child can spend time with the NCP.  Any time that the child is with the CP should not count towards your parenting time.

Is your summer schedule two weeks on and two weeks off?

Yes she is supposed to have wednesday's and every other weekend when I have daughter. We can do 1 week on/off or 2 weeks on/off. which I prefer the 2 weeks on and then 2 weeks off.
