Paying child support, no visitation rights

x( Hi, my husband and i would like to know what we should do. My husband is paying child support for a child that he has never seen nor spoken with. He is around 12 years old now and live in Warrenton, NC, we live in charlotte,NC. I talked with the mother of the child (i'll call him J.) about 4 years ago and she swore that J. would never know that my husband is his father. She says that he calls someone else daddy and was named after him(the other man). Now considering all of this, I can't help but wonder why she would even ask for child support.

is there anything we can do without having to pay the expenses for a Lawyer. What forms can we obtain and how.

ask that her husband who the boy thinks of as his Dad adopt him legally so they can really have that relationship.  Your DH will terminate his rights and her husband will adopt him.

And why are you paying CS?  Well that is b/c even though she doesn't want DH in the boy's life, the money is still very very nice. In fact that is probably why she hasn't asked for him to be adopted by step dad before. She would lose that money.

Regardless if you dh has visitation he will have to continue to pay cs unless someone else adopts him.

If Dh wants a relationship with this child he needs to file a parenting plan and request a re-unificatin plan (supervised at 1st so they can start to build a bond)

What does your dh want???

NO SHE WON"T LOSE THE MONEY,  I live in wilmington, nc and am very familiar with these issues and the laws here.  We spoke to a lawyer about something very similar to this.  Even if this other man adopts your step son, your hubby will still be obligated to pay child support, but the problem with adoption is it takes away all of his rights as a father.

I was always of the impression that the courts would not release a parent from CS obligation unless someone stepped up and acepted the responsibilty, ie. adoption.  But then again, it probably does differ from state to state.
Handle every stressful situation like a dog........if you can't play with it or eat it, pee on it and walk away.......

If he signed away his rights, without an adoption, in most cases, he would still be obligated to pay support.

Adoption takes away rights and responsibilities.

I am in the exact same situation. How do you go about filing a parenting plan? Who do we need to contact? Do we get these forms from the court sytem? Please help!

what courts where the cs order done thru??

Most court sites have the paperwork online with instructions, find out what court has jurisidiction and let me know and I will do some research. I did all my parenting plans, modifications, cs without and attorney.
