I really what you to know how much I appreciate your responses to my questions. Thankyou!

Now more issues regarding my nephew. Like I said the other day the GAL had called, he also called my neice. My neice was informed to call her attorney and tell him to file the paper work to have the child removed.

Her attorney said that is the GAL's responsibility. OK...remember my attorney and I are not parties to this case.... but he has been recieving all the paperwork that the other attorney's have from the courts.

I am tired of the finger pointing and the circles of who should do what.

1) Would it be the PROPER thing to do to have my attorney go and file the paper work?

I truley have never been so annoyed in my life.

It is NOT the GAL's responsibility to ask the court to transfer the child to the custody of a parent. The GAL MAY do so, but the GAL has no obligation other than to represent the child's interests (which are NOT necessarily the child's parents' interests).

Either parent has standing to file a "motion to intervene" with the juvenile court and request that the court transfer custody to that parent.

In court, nothing happens unless someone asks the court to order it.

Not rocket science here.
