Could lose his job at any minute

Hi Soc..

My Dh has been working in the same industry for quite some years. He has made relationships and much more money because of it. He went from being at the bottom rung to a salesperson.

Child Support was set at a lower level and he just got out of negotiations to up the support based on his new income. No paperwork has been signed yet because his ex keeps changing things (what years each get the deduction and now she wants to received the money directly instead of thru the courts). Her lawyer is putting it together and sending it to DH.

The problem is, his industry is failing in our area. He has no college at all. He will be hard pressed to get a job even close financially to what he has now. His company maight be folding very soon.

He would like to change careers all together. I don;t think he has much of a choice. He will need schooling to do that . Honestly, he will probably need schooling anyway.  

Question:

How can he gather evidence that he can not get a job at the same rate?
What do you recommend him do about the paperwork that will be sent for his signature increasing the rate?

Make sure that the agreement is to pay support based on the statewide uniform support guidelines, and nothing else.

There's not much else you can do. If you are laid off, you move for a downward mod, seek work and if you don't find anything in your range, then you will need to convince the court that you're unemployable at anything other than minimum wage, and that the court should permit you to limit your work as necessary to obtain sufficient education to contribute meaningfully to your child(ren)'s support.

Usually, the court will set your support based on minimum wage and then tell you to go to school at night and tuff luck.

Wish it weren't so, but that's what your legislators and congresspersons have done to you, so if I were you, then next time that there's an election -- forget about gay marriage, iraq, social security, etc., and tell each and every one of your representatives that if they don't change the family law system to make it so that there is a presumption of equal physical custody of minor children absent a clear and convincing showing of parental unfitness, that you will vote against them all, until they get the message.
