Daughter's day in court

Hey All,

We had a very long day. The case wasn't called till well after lunch.

When we got there and spoke with the ADA, she stated the defense attorney asked what deal could be made. Remember there were 7 charges and there was some room to deal. The ADA spoke with us and said she didn't want to give up the agg assult charges since they were the biggest and had the most time attached. We decided to offer 1 count of agg assult and 1 count of terroristic threat. The remaining charges would be dropped.  He would get 11.5 - 24 months in county lockup and an additional 3 yrs reporting probation. Daughter would not have to testify and this part of her ordeal would be over. After lunch the ADA informed us he was taking the deal.

He must have had a change of heart when he got in the courtroom. (the prick!!) He decided to roll the dice and see what the Judge would do.  The general consenses was he didn't think she could or would testify against him. Remember in his delusional mind she loves him and they are getting married.

Daughter wasn't aware of what was happening until she was called to testify. She was a mess. The Judge does not allow anyone to sit with someone during testimony. The court crier came out into the hallway where we were all trying to get her calm and said she was able to sit with D. I can't tell you guys how proud I am of D for having the strength to stand up to this prick and put him away. I wasn't allowed in the room as I had to testify also.

The Judge found there was not enough evidence to convict on the agg assult charges and dismissed them. However, much to the suprise of the ADA, she did convict on all remaining charges. She, the Judge was then informed of the stay away order made by a previous Judge and the RO issued in July. She was shown the pile of letters D has received since those orders. I was thrilled by the way she addressed this seperate issue. The judge ordered him to stand and waved one of the many (48) letters at him and said "write another letter, I dare you, One more attempt of any communication and I promise I will max out the time on all counts." I sincerely hope she meant what she said and will follow through with her promise.

The next hearing will be the actual violation of RO held in family court. He will receive additional time, we hope in addition to what this Judge will sentance him on Nov 1st.
Then there is the unrelated case in another county that is yet to be tried.

Given the history with completely disregarding any Judges orders regarding contact, I hope he does continue to write to my D. He will be violating orders issued by 2 different Judges in 2 seperate courts and can/ will be charged in both and I hope sentenced by both.

Good to know that this ordeal is almost over for your daughter.

I know it's been very traumatic for her.  Hopefully she can put this behind her soon and get on with her life.

Whew!  What a terrible ordeal for your family!  I'm so sorry your daughter had to testify after all... my heart goes out to her.  Thankfully, it sounds like you had a decent judge.

Well God bless that judge!  I hope your daughter is doing well after all of the day's turmoil.  I hope he's being held without bail until sentencing.
