Couple medical questions...

Soc, we are in VA - ss burned while at a neighbor's house near bm.  She sent a bill for $322 this week, which included meds, dr visit, bandages, gauze, and we dont even know what some of the receipts were for - there was no explanation.

DH called bm tonight and asked about the neighbor's insurance.  BM responded - 'they rent - and why should they have to pay anything, it was just three kids playing in a back yard?'  (of course, she isnt minding the free haircuts she and ss are getting now from the beautician mother)

DH's court order states he will pay 75% of all uninsured medical and dental expenses of the child and shall include but not be limited to eyeglasses, perscription, prostheses and mental health services whether provided by a social worker, psychologist, psychiatrist or counselor.

1 - Are bandages, gauze, ointment, lotion, benadryl, etc. (over the counter products) considered medical expenses to be covered under the order?


2 - Will bm's refusal to take any part hurt in the long run?

The order says "shall include but not be limited to...", which means that the medical expenses are open ended, and reasonably could and probably would include bandages, etc. (you give me new facts, you get a new interpretation).

Hurt whom? You now tell me that the neighbors rent, which means that they don't have homeowner's insurance, and I'll bet that they don't have renter's insurance either. Which means that they won't have any deep pockets, and so no personal injury attorney will touch the case.

Now, you're gonna be stuck with small claims court against the neighbor and the mother. So, file a complaint and see if you can get some money. Otherwise, you're gonna get stuck with the 75%.

We emailed the lawyer that dh was to see Friday about the all renters - and he responded as you had said....no need to keep the appt.  No way to get the money..and with bm refusing to hold them responsible it would not help matters.   However, he did have someone look into it.  The poperty where accident happened is in fact a rental.  

The child that kicked the bowl however - his parents own.  DH will be sending them a letter requesting insurance information.  Also sending owner's of the other property's request for liability insurance info. as well information regarding whether they require rental insurance.  

Dh is also going to send 50% of meds and the dr bill as they were paid at time of pick-up and service.  All the other bills will have to be justified before any payment as they werent used and one for about $50 gives no clue as to what it is for......

Not any questions...just wanted to give you an update that there is another avenue open to dh.......

DH sent a request for insurance info. to parents of boy who kicked bowl of fire onto ss at another person's residence.  No reply has been given.

SS came this evening - an hour late.  Later, he said they were waiting for someone else to get off of work and ride with them....it was the lady whose home he was at when incident took place.  This seemed odd to us...but now I am concerned.  SS said that on Wednesday evening, his mom took him over to their home and the other family (the kicker's) was there as well.  --This should have been the day they received the request for insurance info. ----   SS was inside, but after a while walked outside and the two men were discussing beating dh.....The one was bragging how he has hurt five other people and that they want to know the next time dh comes to that area...

SS also said they were discussing getting a lawyer for all of them.  BM was sitting in on this entire exchange and taking part in it.  And yes, at least three of them were drinking.

SS is afraid that if anything is said, he will be fussed at and asked alot of questions.  He is also adamant that he does not want his father coming back there because he is afraid he will be hurt....

Soc, what are our options as far as finding out this insurance info.?




If dh refuses to pay anything until something is found out about insurance -citing bm's encouragement to ignore him - will this be go against him?  ((he is going for custody modification on 8/9))

Just one option...lawsuit.

Probably wouldn't be good to be resisting paying for your child's injuries. If you have a claim against someone for inuring your kid, then file a lawsuit. But win or lose, this doesn't relieve you of the obligation of paying for healthcare services rendered on your child's behalf.
