temporary custody

OK I am wondering how long and what we have to do to file temporary custody. BM is living with her esstranged ex husband...in a  1BR apartment. not too bad BUT  SS and his little sister are there  - so 4 people in a 1BR apartment. He sleeps on the couch in the living room. On the weekends he is there - there are 4 kids and two adults in a 1BR apartament! Everytime BM moves and turns the living situation worse than it was prior - SS goes from A's to F's and I am serious - this is NOT an exaggeration at all. Until BM is willing to get a bedroom for SS to sleep in we would like to get temporary full custody. AT least during the school week and on Sunday's since it is a school night.

What do we have to do? How long does this take? What evidence do we need?
