Fathers that are kicked to the curb without due process
« on: Dec 16, 2009, 01:43:16 PM »
I have a great concern regarding the justice system. I have been going through a nasty divorce over nearly two years. My ex-wife has abused the legal system throughout this time and has never been held accountable, for the frivolous charges that were brought against me and were subsequently dismissed.  I do know and have witnessed that the justice system is bias toward mothers and against the fathers in our society in divorce and custody cases. With all due respect society has been telling fathers that they need to be more active in the family since the 1970’s. Fathers have been expected to do more and have picked up the ball. However, the judicial system seems to be stuck in the Stone Age when it comes to awarding custody and allowing the mothers to defile the fathers with lies and false charges to further their cases. I know that the system is overloaded but that does not excuse due process and blind justice. I do hope that the judicial system especially in NC will seriously look at these biases.

My ex-wife suffers from a severe mental illness (Borderline Personality Disorder) and this is documented from several mental health professionals and court appointed counselors. I am a father that cares deeply for my children and their well being. I care so much that I have spent my entire life savings to get just 50/50 custody.  DSS had been involved in our family in the past and I have complied with all the court orders and family plans. I have exhausted all of my resources to get my ex-wife to comply with the court orders and have failed.  I am tired of being presumed guilty based upon a bias in the judicial system.

I wish the judges would take the time to look at the cases and give equal parenting.

yobdab, I totally agree.  I think the family court system needs a drastic overhaul.  In order for that to happen, we have to do more than just talk to each other about it.  We need to talk to the people who write legislation, and demand that they take action.  Find a local chapter of the ACFC and get involved.

I would also like to add that, without due process, the children are also kicked to the curb.

My theory is that most fathers are so happy to be over and done with all of the BS and craziness once the children age out of the visitation/cs phase that they just walk away from the system instead of making any extra effort to change it.  I fantasize about all of the changes I would spear-head on behalf of the fathers just starting out with their fight.  But my husband says that we "no longer have a dog in that race."

I was just thinking yesterday about trying to locate a lawyer in Indiana that would consider representing my DH regarding the shaft he's getting from the state cse office even after his D turned 21 in 09. We have a court order for cs abatement during summer visitation that they have refused to give him credit for since 2000.  CSE wants us to take it back to court. That's absurd. Their judge has already made the order. We shouldn't have to ask him to enforce his own order. If it's happening to DH, I'm sure it's happening to plenty of others out there. It could possibly turn into a class action. But, once again, DH says we'll just pay it and move on. All the while, Indiana CSE has received Federal funds based on over-reporting of child support collections because they refuse to give credit where credit is due.

A total shame and injustice indeed!  I however am on the other side of the fence as I am the mother who lost custody to a father who won his way through court through lies, manipulation and money.  The children are the real victims in this all :(
