I am a new father.  My ex and I have had plenty of contact and always said we would put the child first.  However, 2 months ago she changed her cell number and I did not speak to her until He was born.  I did stay in constant contact with her family.  On the day he was born she refused to let me in the room to see him and only gave in at her mothers urging.  The reason for her acting the way she has is her boyfriend.  Whom she has had a on/off relationship with for 3 years.  I am listed as the father on the b.c., my question is, is it necessary to attain a lawyer.  I would rather keep the courts out, but I do fear he is going to make it very difficult to see my son.  On the flip side I do not want to start in the courts and they break up, like I said she is not the problem.  Any advice would greatly be appreciated.

My advice is to give the bf a good old fashioned redneck a**whuppin!!

Yes you do need a lawyer and to go to court to establish your rights as a parent. until you do the mother has complete control of the child.

Ok, first off,, was a dna test done?

I would advise you to have one done,, especially in light of her on/off relationship with her bf.

Second,, you definately need an attorney.

One of the first things you'll hear around here is "Document, document, document!". Having good records is *crucial*. Get yourself either the Parenting Time Tracker (PTT) at: http://www.deltabravo.net/custody/tracker.htm or the OPTIMAL Custody Tracking service at: http://www.parentingtime.net. The PTT is good, but the OPTIMAL service is definitely better.

I would definitely get an attorney and request the paternity test if there is any doubt that you are the father.  It sounds like the BM is easily manupilated by the bf and you will be pushed further and further away from the baby.

It would be a lot more expense and work if you had to play catch-up at a later date not to mention that you could be called to explain why you put off pursuing your rights.  If the BM is a reasonable person, you and she might be able to come to an agreeable parenting plan with the help of attorneys.  If she is not a reasonable person you're a step ahead of her.

Good luck
