Chit Chat / Was she behind in August....

that is when the tax intercept letters go out.  The first year my ex was in arrears, it didn't happen until after Aug. so I didn't get his taxes the following spring.  Now I get his wife's, because he works under the table.  It's the only time a year I get any CS.  I'm with you on the tax rebate too.

After all him and his wife put you through.  Her claiming your son as her own, they don't want anything to do with him now that he is with you?

I'm sure they have a copy of it.  Unfortunately, the payment he has set up to go out will not get credited, but will be considered a gift to the CP.

Child Support Issues / DH ended up calling WA....

They have no record of him or any CS case.  I guess we'll keep sending it to VA as we have for the past 8 years.

My DH has always paid CS directly to Virginia CSE (no wage withholding).  We currently live in NY.  I went onto his online acct. today to make sure everything was correct.  It came up that he is an out of state case and that their records show he is with a CS agency in Wa state.  On the CP page, it says Va has requested assistance from another state in this case.  We have not lived in Wa for over 7 years.  So, DH called Va CSE to find out what was going on, and the receptionist said that their computer does not show that, that they show his case is still with them.

If we don't live in Wa, can they open an account for my DH?  We don't even have a Wa address.  My fear is that there will be two state's saying he owes them money.  The ironic part of all this is that he only has 9 more payments until SD graduates.

then each child will get their own check.  Those checks will be deducted from the CS obligation.  If they are more than, the ex will not be liable for anything more.  If the CS is more than the kids' checks, the ex will have to pay the difference.

The thing is, she will have to notify CSE, otherwise they won't know the kids are getting disability checks and her CS will continue.

Child Support Issues / That could actually...

get her a higher credit.  It doesn't sound like her income is the same as her DH's, so giving her a 50% credit based on both their incomes could be higher than the credit based soley on her income.

also gives the parties a credit for other children.  It only looks up the obligation based on the parties income, not the spouses.  They look on the table what his obligation would be to our children based soley on his income.  If they added my income into the mix, the amount from the table would be what both of our obligations are.  I hope that is making sense.  The higher the income the higher the monthly obligation, thus only using his income lowers the credit amount he gets.  Also, by the time the credit is deducted from income, then the net is looked up on the table for his portion of CS for SD, it really doesn't lower the CS that much.

Child Support Issues / Yeah, but...

it sounds like the kid is graduating, so there shouldn't be any more modifications.

I'd definitely call the doctor's office and see if the insurance paid on it.

if the mother is indeed pursuing this.  CSE does what they want, and if the order was always with them, then without an order to stop it, they'll continue to enforce it.

Is it possible that the mother has no idea this is going on?  If not, she may help you straighten it out and tell CSE that she wants to drop the arrears.

I know someone going through that right now.  The ex doesn't want the support, but CSE is taking action to collect it anyway.  Both parties are in the process of going to court to get it stopped.
