My Ex left the state with my 4 year old daughter.

I am very lost and confused, I am sure it is not legal for my ex to leave the state with my daughter. I am curently seaking legal advise but can not afford it, if there is any sugestion or ways you guys can help.

Did she give you a written notice through the court of her intent to leave?  What type of visitation do you have, did you see your child frequently before she moved?  Why did she move?  You may want to look into Parental Alienation Syndrome.

You really dont give enough information for anyone to be able to offer help.


1. Are you divorced or were you and her ever married?

2. Based on 1. what is your current court orders?

3. If you had visitation did you excercise it?

Well Sorry, I am new to this, we were not married and have not made any legal visitation arangements. any others questions?

If you were never married and there are no custody orders/visitation/child support orders,, then it was not illegal for her to leave the state.

You have no rights until you file in court for them.

You need to seek legal counsel and start the process NOW before shes been in the new state for six months and established residency.

She is not staying as far as I know, she said she will be gone for "a couple month" I planded on starting the cousty tomorrow

A "coupla months" can rapidly turn into for good. Once she has been there 6 months, you would have to fight in court where she is.  By filing now, you set the jurisdiction where you are prior to her being able to fulfill residency requirements.
