Is this good news or bad news???

Ok well STBX failed to make any of the custody eval appts and now the evaluator is closing the case. Now I thought this would mean I WON right? But then I talked to my lawyer who said that STBX CAN reopen the case- it would almost be a waste of his time but he can!!??  
My lawyer then said he is going to just stay quiet and wait until everything has been submitted to the courts about the closing of the case and then he will approach STBX'x attorney to find out where we proceed next.  
 
Now I am not sure how to feel about this. What do you think?

Sit tight just like your attorney said.

He didn't cooperate during the first round -- that's good for you.

If he wants to reopen, maybe he'll also be footing the entire bill....
