Hi!
  I am going through a battle for custady. My soon to be exwife and I had too take drug tests. We took are drug tests and she came back posative for drugs. The thing is it didnt matter they still gave her placement and took my overnights away that i had twice a week because my son has to get up at 530am so i can drop him off on my way to work. The socal worker also said because we had a domestic,against each other that i am now an abusive husband and i shouldnt have my son at all any more overnights.We both were arrested for argueing but its being held against me.  Not her or the drugs seem to play a part in this at all. Now there saying that 9 years ago i pushed her sister down a flight of stairs and bashing me to the courts.
   I need some advise here on what i can do to help my self out. The divorce is one way and that i am doing but with the drug use still going on i am at a loss here cos i dont want my son around it. The courts say they dont want my son around a man who has a thing against women. I told the courts we dont get along and thats why we are getting a divorce.I have no other cases against me for domestic just the one her and i were arested for and it was just for argueing so we both were arrested so now i have lost almost all my rights to my son.

What the court is telling you is this: they find violence to be a worse danger then the drug use. They show a pattern of violence where you are concerned, or a lack of impulse control.
To the court, its a case of choosing the lesser of two evils.

You can appeal or ask for a re-hearing on the Domestic Violence Injunction. There is always going to be arguments during a divorce. I did this and they dropped the injunction, and then I went back and asked for custody. You may want to try to get a lawyer. Good Luck, JT
