I am a father of 2 boys (4year old and a 10 month old). There mother and I decided that it was best that we seperate ( not married ) for good. It may not have been in the best interest of the children for us to stay together. There wasnt 1 day that we were not fighting over everything. So to make a long story short, its been since the end of January since we have been apart, I have moved on and found someone else ( very loving to me and my boys), and so has she. The one problem is that her new boyfriend just moved back home to Alabama. Now she wants to move down there with him. I dont want my boys that far away from me, nor do i want them living with someone I dont know  ( Ive never met the guy). When she and I seperated we agreed to keep this out of court and do everything on our own terms, but now she is moving and I dont know what i can do to stop her. I want the best for her, but more I want the best for my boys. Which in my opinion is to be close to both parents. But from what i understand she can just up and leave the state (Ohio) without telling me. I need to know what I can do to get her to stay here so i can still be close to my boys. (My visitation is only every other weekend but I'm trying to get back on my feet so I can see them more often. When I can i go to my ex's house to see the boys as much as possible. Also for the time being Im not paying child support as per an agreement between my ex and I, until I get back up on my feet.) Can someone please, please help me or guide me in the right direction.

Loving father of 2

this is not what you want to hear but you have to file a court motion to keep her from moving....well, she can move whereever she wants, just not take the kids with her....TODAY!

if you do nothing and she moves, once she's been there 6 months, you'll be traveling to Alabama not for child visitation...for the court orders she'll be filing for child support, child custody, whatever.

I have the motion papers being drawn up as we speak, Im trying to do this without going to court but she is leaving me no choice. I love my kids more than anything in the world and it feels like she doesnt even care. :(

You will need to file, in addition to the restraining order, for paternity, visitation and child support. You could get hit by back support but it may just go from the date of filing. The agreement you have is nothing.

You may want to avoid court, but it's your only choice now. It's the only way you will have any rights to your kids because when unmarried, you have none, and mom has automatic custody.

Read the articles here. You can start filing on your own but you should get a family law attorney. Good luck.
