I have a 10 yr old girl and have been divorced since 1998.  My ex-wife remarried 3 months after we were divorced.  I remarried about a year later to a great lady with a son who is a month younger that my daughter. The guy physically abused her to the point that I was called one night at 11:30 to go get her by her new husband-I took my little girl to a counselor and she told the counselor of al the stuff her mother told her not to tell me(Beatings, alcohol-of my ex).  I took her to court in FLA and all I got was the removal of the designation of "Primary Residence."  She has  been arrested for aggravated assault and spent a night in jail (all charges were later dropped)
I am now moving to TX and have to file for custody to get her to move from FLA.  MY EX is fighting me on everything.I have read the statutes in the State of FLA and quite a bit implies what is in the best interest of the child. My daughter told her Therapist that she wants to move AND has told hermother that she wants to move with me.  Her mother is fighting out of spite and does not want to give in to me more than listen to her daughter.

Is thier any precidents that anyone knows about concerning custody without the primary residence "tag" associated with it?

Here's the problem associated with the tag of " no cp" or true coparenting: It doesnt work when two parents absolutely cannot or willnot agree on things.

Sad but true.
