I was married to a man for 2 years when things weren't going well we seperated but not legally. while we were appart I was raped and concieved a child. me and my husband got back together when I was 4 months along we had always been trying to have a baby so we just considered it a blessing that we would have one now from my terrible ordeal. my son was born and his name was put on the birth certificate even thouygh he and i both knew that he wasn't the father. Things got bad between us again with him being to possessive and controling so I tried to have him leave, but he wouldnt untill I found out that he was renting another residence and forfieted on our house that i found out he didn't even set up a contract for deed. he moved out and I got kicked out of my home. I felt it was best for him to keep our son for a few weeks till I got a place. I felt it was the best for my baby since i was then homeless. since i didn't have my baby with me i was unable to get public aid to get a home until just this febuary(It has taken me over 2 years ) also had to crawl out from under the bills he had in my name when we were together and he didn't pay them and i couldnt because he wouldnt allow me to get a job now i have a home and am haveing trouble getting him to agree to let me see my son since he's parinoid that i'll take him wich i do want to do but i main;y just want to see him as much as i possibly can, It always a fight to see my baby and hes talking about moving 3 states away now I want to know if i would get in trouble for parental kidnapping if i just kept him on one of my visits and had a restraining order placed on him. we are not legally seperated and there are no custody papers stating anything. i dont have any money to get a lawyer to have a court ordered blood test done he has kept my son because of me being homeless because of him. I have currently just lost my job again so i hope i wont be homeless again. how can i get my son back!!!!

I'm sorry, sounds like you have no manner of luck at all.  I can tell you that if you have no job, no money, no home.  You also have a real problem.

You should try getting an agreement in place with your X.  There may be free services in your area through a fathers rights group.  I know how that sounds but the truth is most of these groups believe very strongly in fairness and the best interest of the children.  It's not binding, it will most likely make your ex feel comfortable (since it is a fathers rights group), and in the end it will save you all a huge amount of money and stress.

If you don't like this idea or if your ex wont agree on any level then you should talk to SOC.  If there's no action in court yet there's probably a lot you can do.  But I doubt you can do it for free.

Why haven't you been visiting your son for 2 years?  That will look very bad to the court.

Do you pay Child Support?  If you don't that will look bad to the court.

No job, you may lose residence.   That will look bad to the court.

Do you have a record of any crimes, drug, violence?  If you do it will be a major issue with the court.


**Start by maximizing your visitation.  If he is afraid you will take the child get an agreed upon supervisor to be with you during visitation.  

Remember, you have not seen your child for 2 years you need to develop a relationship with the child.
