fighting for custody

i live in michigan and would like any info that anyone can provide me.
heres the story 3 years ago the bm told me that my parental rights were terminated which was not true but i was new to the process and didnt realize it so december 2002 she took my children to ohio to live with thier grandma and i was served with papers on a tempory custody order to grandma i immediately filed for custody in michigan needless to say i was not given custody which i can understand because at the time i had not seen my children in a year but since april 2003 a visitation order was put in place and i have done everything that the court has asked me to do plus.  heres the thing on june 4th 2004 ex dropped the children off for a weekend visit she stopped by on june 7th and asked if i would keep the children over night i agreed she said she would pick up the children in the morning to take them to school never showed up later that week we talked and she agreed that i should keep the kids for
the summer she threatened to take the children back on july 11 so on july 12 i filed for custody again she was served on july 14 on july 15 she took the children out of the household also i should mention that i enrolled my son in school for the summer after his teacher recommended that he go what are my chances to have custody changed to at least joint custody so the children go to school with me

Ok hoss, your story doesnt really say much. What are the current orders? Why did you file for custody? What has changed ? WHO HAS custody?? When you filed for custody this time did you file a restraining order? and on what basis if you did?

One of the first things you'll hear around here is "Document, document, document!". Having good records is *crucial*. Get yourself either the Parenting Time Tracker (PTT) at: http://www.deltabravo.net/custody/tracker.htm or the OPTIMAL Custody Tracking service at: http://www.parentingtime.net. The PTT is good, but the OPTIMAL service is definitely better.

sorry i didnt want to make it too long but as it stands right now bm has sole custody legal and physical i have reasonable visitation
during this past year i was informed of a couple of things
1 my ex admitted to using cocaine and is currently going to na meetings says she is clean but that is just her word
2 both my daughter and my son have experienced difficulties in school my daughter was even begging for food at lunch time which will be documented by the teacher
3 my ex was seen by my children in lesbian affairs i.e. french kissing women sleeping in the same bed
4 she is going through her second divorce in one and half years
5 she has to move again with my children
there are some other circumstances but i do not want to make this too long
when i filed for custody they said i would have to give her back the kids if she came to get them and there was nothing i could do

Ouch,

I assume you didnt have an attorney when you divorced?

If you did,, why was she awarded sole?? ( ie; is there skeletons in your own background).


You DO have sufficient change of circumstances in her home to try for a custody mod.

In your filing, I would also request drug screenings, just to see if shes clean. Heres the kicker,, if shes clean AND sought help the cocaine issue is moot.

Get an attorney and give it a try.

basically what she got me on was lack of contact with the children but how much does the judge look at the schooling both of thier teachers state there is no stability in the childrens llives that is what i am focusing on not the drug problem because i dont want to go in there and basically attack her on her character i do have a drunk driving which i got on st patricks day and i paid to have an assesment done which states that i do not have a problem what about joint custody is it easier to obtain that with me being the primary custodian i am clueless on this like i said i got slammed on the last hearing and i have no faith in the legal system it seems like no matter what i lose and so do my children
