I am a father that has been taken advantage of. My ex-wife recives 1,500. in support a month for one child. My salary yearly is in the LOW 30's (do the math)   I am also responsible for health insurance, any bills that are not covered by the insurance, $200,000. in life insurance ( payable to my ex-wife). She has been remarried for a year now, driving a brand new Range Rover. We just sold our house and all I saw of the sale was maybe 30%. I had to pay off past bills and by a car. Which I needed ( my other was reposessed) due to over paying child support.  I have asked for a reduction in support, I have tried to make her understand that she is makeing me almost homeless. She does not care, I think she would rather it happen, becauseit would give her reason for me not to see my son. I only get to see my son, two and a half days every other week ( my son asks for more days. But there is nothing I can do, she refuses to allow any more visitation. She will not even talk to me, I talk to her thru her husband. I am a VERY GOOD father and I need HELP. can any one help??? please

HI, What are your CS payments set up through?  If it is a division like DCSE, you can request a modification in CS by filling out a form and mailing it in.  If you direct pay at this time, court would seem the way to go.

For your salary, I cannot see that kind of payment.  Does she work at all?

The medical part is very unfair as well.  Still, court is the way to handle this.  Even if she is not working, you are to support the child and it does not take $1500 to take care of a child for one month.

Best of luck!

You may seek a modification of your child support if it does not reflect child support guidelines in your State.  To know if you are overpaying, you must understand thiose guidelines.

You need to start learning how family law works in your area.  That is the ONLY thing that will save you.  Obviously, you can't afford an attorney, so it's really up to you.

There will be no short-term relief-- you need to take some serious time to learn about the system so that you can file what needs to be filed.

In the meantime, document her lavish lifestyle and your pauper lifestyle.  If she doesn't work due to her husband's income, the court will assign her an income for the purpose of calculating child support, and the court usually has some discretion with that.  If she's living in luxury, the court may pick an income imputation (i.e., what she COULD be earning) near the upper end of the possible scale.
