Change in circumstances

   Hello everyone, have a question about change in circumstances. The ex petition the courts to appoint counsel to my two children ages 12 &14. We have had 50/50 custody now for 4 years, last year the ex filed for custody changes, claims that their has been a change in circunstances. Up untill now everyone has neglected to prove a change, ex petition the courts to appoint a lawyer for the kids, judge honored that. We have all met with the kids attorney and it was discovered that thier has not been a change in circumstances but the ex wants to still push for a change. The kids attorney say's that she was ordered by the courts to represent the best interest of the children. What has come out of this is the child preference for the most obvious reasons. The kids attorney said that I seem to be the most descipline parent and the most resposible one and siad that I should just keep doing what I'm doing. The children said that they want to live with mom because they are tired of going back and forth. My position is that if that is the only reason then why does it matter who you live with just as long as the running stops.


          I feel that because thier hasn't been a change in circumstance as she claims there was and we all now agree that thier isn't, why isn't this whole matter being dropped? What I see now is a childs prefernce that has no merit because the kids didn't say anything bad about me at all other then they want to live with mom and tired of going back and forth.

       We have to meet Tuesday, all the attorneys, myself and ex to come up with a new agreement which I amm ok with just as long as I don't lose anytime with my kids, the ex attorney is suggesting that thier mother has them most of the time, I'm not ok with that. It is my thought that we have one week on and one week off with Wednesday being a visitation. That was the schedule that I had in mind from the very beginning but the ex didn't want that and we took her goofy schedule.

Since the kids don't want to do anymore "running around" why not make it week on/week off, with A) on Monday's being the drop off/pick up time or B) Tuesday's, as there are some 3 day holidays or when school is out on Monday's.

I just don't understand why there needs to be a visitation during that week with either parent. They are old enough to go one week, or long without seeing the other parent.

Here is another idea......Do 2 wks on, 2 wks off.  That way they aren't being shuffled as much.

Still the same amt of time.

I have other ideas, but I don't that neither you nor your EW would go for it.

Do 2 mos, with you with her getting eowknd/mid week visit,
then 2mos, with her, with u getting the same as before. or make the months longer.

I would highly recommend the 2 wks on, 2 wks off no visitation in between UNLESS the children would like to, then its up to them, to ask the parent they are with if its ok, and also the parent they are wanting to see to make sure that NO plans have been made on the other side.
( just for an over night visit or for a couple of hours.)  NO LONGER than 1 day.
