Wife Abandoned Home

Does anybody have experience with the wife abandoning the home, removing the kids, taking all the belongings, and leaving you with all the bills.

My court date is in August and I want to know if I should be prepared to leave the house or remain. We are fighting over custody and my attorney informs me that the wife's departure will help in the custody and assets.

I can demonstrate to the court that I have mainained the home for the children even though the children have been removed.

Do you have anything with the courts yet? Was she given temporary custody? How old are the kids? Did she remove them from school?
As far as the house in concerned, she abandoned the house. Pay what is in your name so your credit doesn't go downhill.

At the pendente lite she got custody of the kids, and lives with her parents. I was ordered to maintain the upkeep of the home which I do. The children are under the age of 6. I have made repeat reasonable offers of a buyout but she always comes back with ridiculous counteroffers. I've decided I'll just try to stay in the house. My attorney states that this will help in the custody because of appearance that I provide a stable enviroment, and I agree with him.

I got almost the same situation. My wife and i were trying to buy a house and were renting from her sister at the time. Her credit was poor and my credit was fair and we did not receive the loan. she was obviously devistated and took it out on me. She started picking arguments telling me to leave and talked about a divorce. After we agreed to work things out, she got her move out plans in the works anyway! within months she got some of her 401k money and bought new furniture with it. Mind you the furniture we had was stuff that i already had from my apartment, so that stuff got thrown out. She then worked out something with her newly married sister about her sister's other place she was renting in Northern Va. (we lived in Maryland and she works in D.C.). All the while i'm thinking things are getting better with the relationship! On April 6th she informed me she was moving out and i had less than a month to find a place to live! At the time i had loans to repay and was flat broke with not enough credit to get a reasonable place. So here i am with a place i got by taking another payday loan i couldn't afford waiting for the car to be repo'd and getting a letter for child support! I know this doesn't answer the question but i just wanted you to know there is people in the same waters your boat is floating on and i'm sinking fast with no daylight in sight! If anyone knows an answer to this please shed some light as to what to do!

Since neither of you own, you are in a better position. From my read, I do not know if you have children. You really do not want to leave her with the children because she will argue primary care giver; that's if you want full custody of the children.

If you are in MD, get ready for a great deal of BS. I live in MD as well. Just be patient and get ready.
