Custody of Daughter

My daughters mother gave me custody back in January because of problems that my daughter was having in school. She stated that she needed to be with a family. I took my daughter and placed her in a new school were she has thrived and is doing great. My daughter is doing really well with us.  School is out now and the mother wants to take her back but my daughter who is 12 wants to stay with me and my wife. I cannot afford an attorney and do not know how to fill out the papers to obtain custody of my daughter. I am at a loss on what to do, any help with this topic would be greatly appreciated.

If you really can't afford an attorney, you will need to file for modification of custody and an emergency order to modify (so you can sign her up for school).

You need to go to the court house that has the order and ask for change on custody (and since mom wants summer visits you need emergency hearing so mother does not keep her)  since child has been with you and has gone to school by you for the last 6 months. Have copies of her report card to show proof that she went to school by you and her grades improved. I would be careful if she wants her for summer visitation until you get the emergency order or she can not say she has custody and keep her. Good luck!
