My ex husband has my daughter,he told me that she is going to come live with me,I need to know what I need to do so that he dont change his mind and say that I never returned her after summer visitation.She also told me that he plans on moving after she moves here.He is willing to get a statement notarized stating that she is goingto live here.Should I take that to an attorney in my state after I get my daughter for the summer? please help

If you have a statement notarized with his signature, you're protected and he won't be able to claim that you didn't return her.

However, that doesn't guarantee that he can't change his mind and ask for her back. In order to ensure that he doesn't ask for her back, you'll need to obtain custody. There are two general ways you can do this:

1. After she has lived with you for 6 months, you can go to court in your current state and file for custody.

2. If he's being cooperative, you can have your attorney prepare a document stating that there has been a change in custody and that you both agree to it. VERY IMPORTANT: this document is meaningless until it is approved by a judge. So, if you can get your ex to agree to it, have the document prepared and take it to the judge - in the state where the child lives today - to be approved by the court.
