Summer Parenting Time

Both BM and My Husband have 2 week Summer time with SD.
Every other year they alternate the notification date.
May 1 or May 15.
 May 1 is BM's date this year. If she gives no notice of her intended dates she wants for summer, is she still intitled to the time?
Or does she just loose first pick for this year?
 She's never took her two weeks Summer time before.
Just curious.....
We are sending our notice of time May 7th, via certified mail, and stating she has not given her notice.
We are palnning vacation and don't need her to try and mess them up, just because she doesn't follow a court order.
