Her and kids live in New Mexico
Me lives in Arizona (2 hours away)

In january we met with lawyers over summer plans.  We agreed to that I would have five weeks of summer time with them (which is what is in the parenting agreement approved by the court in NM in Feb 2005) I said they could play sports and would move my time with them to the last five weeks.  I was to pick them up last sunday 7/8 but she said since baseball season won't end for one of the boys the youngest that I have to said until the 18th of July.  I had made reservations for hotel back in February for next week to take them on a little trip.  The meeting was verbal and not written or signed.  Am now looking at only having 3 weeks instead of my 5 weeks.  She does everything she can to keep the boys from me.  I said then I want a refund for my support for the month of July and she refused.  

Lawyers seem to be too busy (i understand that) but am losing out on time with my kids... what to do?

Since you did not inform her in writing with certified receipt when you were getting the kids I am not sure there is much more you can do.  In the future, send her a certified/fed ex or something in writing about the dates you plan to pick them up.  Always send a copy of the letter to your lawyer.

My lawyer has instructed me not to talk to her due to her rants and out bursts.  My laywer sent her lawyer all dates and times for pick up.

Perhaps you can file a contempt charge against her then?  Is there an actual court order that gives you five weeks with your sons during the summer, if so - file.

I am sure you realize this yourself, but you said this five weeks was a verbal agreement.  You always need everything in writing and court approval is the only way it can be enforced.......

If there arent many games/practices right now, couldnt you still pick up your son, talk to the coach and show up for say one practice and the game?  Two hours is do-able....not easily, but could be done so that you could still have your sons...

The parenting plan is court filed 2/05 and states 5 weeks.  However, she says that I agreed to less time so the boys could play baseball which isn't true. The less than five weeks is no written.

The boys told me they would rather miss out on the last few games to be with me, but "mom" said no.  I want them to have fun, but I so want to spend time with them. :(

If the parenting plan filed with the court says 5 weeks, tell her when you're picking the kids up. Take a copy of all documents with her and if she refuses, call the police. Then file an emergency order with the court to hold her in contempt - and make her pay all your expenses.

If is doesn't state in the order you have to takes the kids to their sporting events then you don't you get them on your scheduled time and what you do with them in your business not her.

It is hard w/ sports-my son goes to his grandma's during the summer usually towards the end as he plays allstars for baseball (excep this year he didn't) and he understands that he may miss a few games.
