Auntie B's child custody questions

My neice had her children taken away in Jan. of this year by children services (CS) One child went to his father and the other child went to a legal grandmother. The day the children were taken I had called CS about a million times and continued for weeks to try to get some answers on why my calls were not answered and why I didn't recieve the remaining child who went to stay with Legal Grandma (LG).

 In Feb. my attorney and I filed a motion to intervene. A week prior a GAL came to my house and LG's house. The GAL chose my husband and I to recieve temp. custody. At the hearing in feb. we only got through the adjudication hearing pending the results of genetic testing, which was ordered by the Judge due to the GAL request that this be done.

1) if legal father is not biological father, (father also lost custody to cs due to drugs) will we recieve custody?

2)If we hear that the LF is not the BF can we file an Ex parte order even if we have yet become parites to the case? We have yet been granted our motion to intervene due to not going through the dispostition hearing.
