Summer Parenting time
Court papers state:
    "Each party shall be granted two weeks of Summer Parenting time, which will begin at 6 pm Friday and end at 6 pm on the third Sunday following the Friday when the parenting time starts. The mother shall notify the father by May 1st of 2003 as to when she intends to exercise her summer parenting time for the current year, and the father shall let the mother know of his intended vacation by May 15th of 2003 as to when he intends to exercise his summer parenting time. Thereafter, the parties shall alternate the notification date."

    Regular Court Visitation for dad is;
 1 week~ Thursday from 5pm or such time child is released from school or daycare until Saturday at 10am
 2 week~Thursday from 5pm or such time child is released from school or daycare until Sunday at 6pm

   Holidays alternate every year.
   Under Holiday Parenting time it states;
  "This holiday parenting time schedule shall supercede the regular weekend parenting time schedule. The regular weekend parenting schedule will continue with the parent who did not have the child on the previous holiday and continue on from that point., alternating between the parents every other weekend"



    Dad already sent a certified letter of his intended summer parenting time after May 4th. In the letter he stated he has not received notice from her of her intent to exercise her right to  two weeks in the summer.That he needs to plan accordingly for the summer, if he did not receive a response via U S mail by May 25th, 2005 , that the dates he gave for his time would be confirmed AND She ( mom) does not intend to exercise her summer parenting time.

Mom has never exercise her rights to summer parenting time in the past, but has told us of her intentions not to exercise summer parenting time on or before her notification date.

Mom responded  by May 24th 2005. In the letter she confirmed the dates Dad picked and she stated that this holiday time schedule will supercede regular weekend parenting time, and At this time, she does not have dates planned out for Summer Parenting time.


1. If Mom does not notify dad of intended summer parenting time by the date stated in the court papers, Does she waive her right to her two weeks?

2. Mom has stated that the summer parenting time starts on Friday not Thursday, But Thursday is dad's regular visitation weekday. Can mom  take away his Thursday before his two week summer time?

3. Is mom allowed to give little or no notice of her two weeks summer parenting time?

4. If little or no notice is given to dad for mom's intentions of summer parenting time can dad object if he has already made plans with their daughter?

Yes, but you can certainly accomodate a later request in order to keep the peace.

No.

The court orders state what is permitted. If she fails to give notice, then the presumption becomes that she will not exercise custody.

He doesn't have to object. If mom doesn't give notice, then Dad is relieved of the obligation of granting visitation other than what is ordinarily in force. But, as a practical matter, if Mom sets up a vacation, and the child isn't busy, then what's the harm in letting Mom have the child. Point is, you should have a good reason for denying time, especially if the child wants to go with Mom.

I understand, that there are schedules that must be planned, but, I'm talking about the circumstance where the child's schedule will permit visitation, but you are opposed to it on "principle."

It's not worth the fight.

 Dad isn't going to deny summer parenting time, as long as it doesn't mess up important plans.
Mom has denied their daughter from attending her 1/2 brother and her very close cousin ( who is the same age & grew up together) birthday parties. We try and plan birthday parties when we have My stepdaughter, But sometimes it just doesn't work out that way. We ask if my step daughter can attend for an hour or two and we would provide all transportation, Mom still says no.
 The reason I ask about the Summer time is my oldest daughter is having a birthday party in July on the weekend dad has daughter. Mom will try and catch wind of the date and keep their daughter from attending her step sisters party.

It's really sad, especially since I'm the mother of my step daughters only siblings( 1/2 sister, 1/2 brother and a step sister). Biomom is mad at me and thinks she's punishing me, but she's only punishing the children.
