CS Modification

Hello,

I am a disabled NCP in Montgomery County , Texas.

Current CS Order issued in 2001 for 700.00 CS and 300.00 arrearage for medical bills, amount totallying 14,537.19.

CS arrearages paid in full as of July 2001, order was not changed.

I was awarded SSD in 2002, as was my son under dependent benefits. I was awared 1615.00 per month, Son awarded 808.00 per month.

CP is receiving both the 1000.00 per month garnishment and the 808.00 SSD benefit.  To date she has been overpaid 11,119.19 on the arrearage medical.

I need a modification.  I cannot afford an attorney.The County Clerk will not provide any answers only that a court date will be mailed to me 5-7 days after filing Motion.

I have the Modification prepared to file myself but have some questions.

1. Does the Modification request need to be typed in a certian size font?

2. Do I have my X-wife served before or after I get a court date?

3. How many days prior to the hearing does she need to be served?

Note: All of your questions fall generally under the concept of civil procedure rules. Unfortunately, there is no official set of the Texas Rules of Civil Procedure online, therefore my comments below are merely educated guesses, because I can't look up your questions. You will need to visit the county law library or purchase a copy of a TX civil procedure manual to obtain correct info (or hire an attorney).
