trying to get custody

I have an 11 year old son in Texas. I live in Michigan. I have recently come to find out that the mother has basically been mentally abusing him for years.
1. What is my best option to try and obtain custody?
2. Will the court take into consideration his voice when he turns 12?
3. Will this have to go to trial?
4. Legally do I have a leg to stand on?

I tried following the instructions but struggled with the 5 days?

What sort of proof of your allegation do you have?

Court weighs child's maturity to make his wishes known to the court in an intelligent and informed manner. There's no bright line as to age in TX.

I don't read tea leaves.

I could make a really silly joke here about amputees, but it would be in bad taste so I won't. You need to tell me the facts that support your allegations of abuse. If you have credible third party evidence that the child has substantially suffered at the hands of his mother, then you may have a good case. If not, then not.
